<br />to vacate the unit. If during the year, a Target Unit becomes <br />available and the tenant meets the income eligibility for that unit, <br />the owner shall allow the tenant to apply for that unit; <br /> <br />b. If there are no units designated for a higher income category within <br />the Housing Development that may be substituted for the original <br />unit, the tenant shall be given one year's notice to vacate the unit. <br />If within that year, another unit in the Residential Development is <br />vacated, the owner, at the owner's option, may allow the tenant to <br />remain in the original unit and raise the tenant's rent to market-rate <br />and designate the newly vacated unit as a Target Unit affordable at <br />the income-level previously applicable to the unit converted to <br />market rate. The newly vacated unit must be comparable in size <br />(for example, number of bedrooms, bathrooms, square footage, <br />etc.) as the original unit. <br /> <br />6-3114 Child Care Facilities <br /> <br />A. When an applicant proposes to construct a Housing Development that is eligible for a <br />Density Bonus under Section 6-3104, and includes a child care facility that will be <br />located on the premises of, as part of, or adjacent to, the Housing Development, the City <br />shall grant either: <br /> <br />1. An additional density bonus that is an amount of square feet of residential <br />space that is equal to or greater than the square footage of the child care <br />facility; or <br /> <br />2. An additional Concession or Incentive that contributes significantly to the <br />economic feasibility of the construction of the child care facility. <br /> <br />B. The City shall require, as a condition of approving the housing development, that <br />the following occur: <br /> <br />1. The child care facility shall remain in operation for a period of time that is <br />as long as or longer than the period of time during which the Target Units <br />are required to remain affordable pursuant to section 6-3106. <br /> <br />2. Of the children who attend the child care facility, the children of very low, <br />lower and moderate income households shall equal a percentage that is <br />equal to or greater than the percentage of Target Units in the Housing <br />Development that are required for very low, lower or moderate income <br />households pursuant to Section 6-3104. <br /> <br />C. Notwithstanding subsections (A) and (B) above, the City shall not be required to <br />provide a Density Bonus or a Concession or Incentive for a child care facility if it <br /> <br />ORDINANCE NO. 2006-010 <br /> <br />12 <br />
