<br />MINUTES Page 6 <br />City of San Leandro City Council, San Leandro Redevelopment Agency, and San Leandro Public Financing Authority <br />Joint Meeting-May 15, 2006 <br /> <br />Mayor Young commented that this public hearing was delayed in order to include Vice <br />Mayor Grant in the discussion. Mayor Young stated that since her residence is within <br />500 feet of the proposed project, she would recuse herself from voting on this project. <br />She turned the gavel over to Vice Mayor Grant and left the Chamber. <br /> <br />This being the time and place for the Public Hearing on the above matter, Assistant City <br />Manager Steve Hollister gave an overview of the matter and introduced Planner II <br />Elmer Penaranda. Mr. Penaranda gave a short PowerPoint presentation describing the <br />proposed project. <br /> <br />Vice Mayor Grant thanked the Council for delaying the matter to tonight in order to <br />allow her to participate. <br /> <br />Richard Larson, the project architect, addressed the City Council, expressing no <br />objections to the Conditions of Approval. <br /> <br />Vice Mayor Grant asked if the property owner will maintain control of the property. <br />Mr. Larson indicated that the owner has no intention of selling the property, and the <br />property has been in his family for a long time. Vice Mayor Grant then asked staff what <br />would happen if the property owner sells the property within five years. Mr. Penaranda <br />indicated that this concern would be addressed in the Owner Participation Agreement <br />(OP A), which will require that the applicant and/or property owner shall be responsible <br />for assuring the successor in interest is informed about the conditions. Ms. Williams <br />affirmed that the OP A will rollover to the successor. <br /> <br />Vice Mayor Grant asked about the conditions for changing use for the property, such as <br />conversion from used car dealership to car rental. Ms. Williams indicated that the City <br />has approval authority over the type of business conducted on the property. The OP A, <br />which will come back for Council approval after negotiations, will set forth the <br />parameters, guidelines and type of desired development for the property and adjoining <br />properties. Mr. Horn added that the interim use permit is only for used car sales. Other <br />uses will trigger a new use permit requirement. <br /> <br />Vice Mayor Grant expressed interest in including a restriction in the OP A limiting the <br />hours on the delivery of cars She indicated that at an existing used car dealer located at <br />l43rd Avenue and East 14th Street, the transporter unloads the cars in the median strip of <br />East 14th Street during the middle of the day. Vice Mayor Grant stated that she also <br />wished to see restrictions on signs other than the monument sign, such as inflatable <br />objects and flags. <br /> <br />Vice Mayor Grant expressed concern about disposal of wastewater generated by the car- <br />detailing activities. Mr. Larson indicated that cars will not be washed on-site. <br /> <br />Councilmember Santos commented that the Matthews-Brooks family should be given <br />an opportunity to turn this nonproductive property into a productive property for a short <br />period of time. <br />
