Mr. Horn responded that it is appropriate to place the conditions in the Conditional Use Permit and the OP A can reference the Conditional Use Permit. The Hearing was then opened to the public. Lou Filipovich, San Leandro resident, addressed the City Council, commenting that this matter should be referred back to BZA. There being no further comments from the public, and without objection, the Public Hearing was closed. Mr. Penaranda swnmarized the recommended amendments to the Conditions of Approval. Councilmember Nardine asked where the loading and unloading of vehicles will take place if the transporter carmot use the right of way. Mr. Penaranda commented that the vehicles can be driven from the wholesaler to the site, avoiding the use of a transporter. If a transporter is used, the transporter will need to pull on the site for loading or unloading. Councilmember Starosciak asked if business hours include deliveries. Mr. Horn indicated that operating hours can include vehicle deliveries. Mr. Hollister stated that Ms. Williams has recommended language for regulations on delivery of vehicles as a more realistic resolution, to allow unloading on East 14th Street, but not on the travel way. Ms. Williams proposed language for Council consideration. .
