<br />1537 Hays Street; PLN2005-00141 <br /> <br />3 <br /> <br />September 5, 2006 <br /> <br />. Testimony at both Planning Commission meetings and correspondence received from the <br />Garden Terrace condominium owners stated opposition to the proposed project (see <br />attachments). The opposition was based on the proposed project's impacts on the adjacent <br />north-facing condominium windows and impacts on their privacy. <br /> <br />. After the Planning Commission action to recommend approval of the project to the City <br />Council at its June 22, 2006 meeting, City staff and the applicant continued to meet and <br />correspond with the Garden Terrace owners and its condominium association. The purpose of <br />the additional outreach with the neighbors and the association was to look at possible measures <br />that the applicant could take to address the concerns expressed by Garden Terrace property <br />owners about privacy, views and property values. On July 26, 2006 a meeting with the Garden <br />Terrace owners and the applicant was conducted by City staff. Various design revisions and <br />other measures were discussed that were subsequently agreed upon by the applicant to address <br />the Garden Terrace owners' concerns (see attached Letter to Garden Terrace owners and <br />Attached Memorandum containing Notes for the July 26 Meeting on 1537 Hays Street). <br /> <br />. The Recommended Conditions of Approval have been revised accordingly to include the <br />post-Plarming Commission meeting revisions that were agreed upon by the applicant. These <br />revisions were inserted at the end (last page) of the attached Revised Recommended <br />Conditions of Approval. <br /> <br />Current City Council Policy <br />Not applicable <br /> <br />Previous City Council Action <br />Not applicable <br /> <br />City Council Committee Review and Action <br />The proposal was presented to the Business Development Subcommittee on May 11, 2006. <br />In its review the Subcommittee made no specific recommendations regarding the project. <br /> <br />Applicable General Plan Policy <br />The General Plan Land Use Map designates the subject property for Residential High <br />Density use. The current Zoning Map is consistent with the General Plan and designates the <br />property as a RM1800 Multi-Family District. The proposed modification of the zoning <br />designation to the lower density RM2500 District is conditionally compatible with the <br />Residential High Density General Plan designation (General Plan Table 3-2). <br /> <br />As proposed with six units, the overall site density would equate to approximately 17 <br />units per acre (six units on 15,000 square feet, or one unit per 2,500 square feet). The <br />existing RM 1800 zoning could permit a density of up to 24 units per acre, or eight units <br />on the subject property. Although the project does not require a rezoning of the base <br />district from RM1800 to RM2500, it has been the City's practice to rezone the base <br />district so it reflects the proposed density. <br />
