<br />Excerpt/rom the Planning Commission Meeting Minutes <br />Agenda No. 06-12 <br /> <br />June 22, 2006 <br />Page 6 0/7 <br /> <br />privacy for the potential homeowners of the proposed project. <br /> <br />The Applicant noted that Mr. Williams' proposal would only move the front unit on the <br />southern side of the project about five feet back from the street, which would result in a <br />very limited improvement to Ms. Goodall's view from her windows. He said the 22-foot <br />distance of separation between the 1599 Hays and the 1537 Hays buildings as proposed <br />by the applicant is in excess of the nine-foot separation proposed between the new 1537 <br />Hays units. He noted that the City had approved residential projects with walls separated <br />by as little as four feet and that these walls include windows. He asked the Plarming <br />Commission to approve the project as currently proposed. <br /> <br />Mr. Dlugosh noted that there was no homeowners association planned since the <br />properties are divided into six parcels exclusive of the driveway and parking. He asked <br />whether the two westerly properties owned the overflow parking spaces associated with <br />them. <br /> <br />The Applicant said the overflow parking spaces would be included in an easement, just <br />like the rest of the driveway, and would be maintained through a joint road maintenance <br />agreement, as in previous Langon projects. <br /> <br />Commissioner Wohltmann asked if the applicant had shared the landscaping plan with <br />the neighbors when he met with them and whether the owners had indicated they would <br />perceive the trees as an acceptable mitigation of issues related to views and privacy. <br /> <br />The ApplicaDt said he had not shared the landscaping plan with neighbors and did not <br />know their reaction to the proposed trees. He said the landscaping plan was based on <br />Planning Commission recommendations made publicly at the previous meeting. He said <br />the landscaping plan, as of now, was only conceptual. <br /> <br />Motion to Close the Public Hearing <br />(Dlugosh / Holcomb; 6 Ayes, 0 Noes; Absent - Reed) <br /> <br />Commissioner Holcomb said she appreciates the change of the driveway door in the <br />front units to windows, the fact that there-is a continuous front porch facing Hays Street <br />which creates more street interest and the appearance of a single-family dwelling, and, <br />the fact that there are more trees included. She said she was not sure how a developer <br />could meld two totally different projects any better than the project plan as currently <br />proposed. <br /> <br />Commissioner WohltmaDD said he is still concerned by what he perceives as a <br />significant impact on neighbors residing at 1599 Hays. He said he feels more could be <br />done to mitigate their concerns and would be interested in their reaction to the <br />landscaping plan. He said he does not believe the project as proposed meets the <br />requirements of Item 2 at Page 2 of Staffs Recommended Conditions and Findings. He <br />said he does not feel enough mitigation had been considered or implemented. He said that <br />residents of Garden Terrace reside in San Leandro, have made substantial investments <br />and are taxpayers. He said he believed the residents at 1599 Hays deserve as much <br />consideration as the city can afford in looking at a new project. <br />
