<br />KNOW ALL BY THESE PRESENTS, That we, Alameda County Industries, Inc., as Principal, and the
<br />Fireman's Fund Insurance Company, a corporation organized under the laws of the State of California
<br />and authorized to transact the business of surety in the State of California, as Surety, are held firmly bound
<br />unto the City of San Leandro, as Obligee, in the penal sum of One Million and 00/100 Dollars
<br />($1,000,000.00), for which sum, well and truly be paid, we bind ourselves, our heirs, executors,
<br />administrators, successors, and assigns, jointly and severally, firmly by these presents.
<br />NOW, THEREFORE, the condition of this obligation is such that:
<br />WHEREAS, the above bounden Principal has entered into a certain written contract with the above named
<br />Obligee, dated ~ 3 D far the performance of the following described work, to-wit:
<br />"Solid Waste, Recyclables, and Green Waste Services"
<br />which contract is hereby referred to and made part hereof as fully and to the same extent as if copied at
<br />length herein.
<br />NOW, THEREFORE, THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, that if the above
<br />bounden Principal shall faithfully perform the work contracted to be performed under said contract, then
<br />this obligation shall be void, otherwise to remain in full force and effect.
<br />Said Surety for value received hereby stipulates and agrees that no change, extension of time, alteration or
<br />addition to the term of the contract or the work to be performed thereunder or the specification
<br />accompanying the same shall in any way affect its obligations on this bond, and it does hereby waive notice
<br />of any such change, extension of time, alteration or addition to the term of the contract ar to the work or to
<br />the specifications.
<br />PROVIDED, HOWEVER, the Surety shall not be liable under this bond for an amount greater in the
<br />aggregate than the sum designated in the first paragraph hereof, and shall not be liable as respects any
<br />obligations related to said agreement occurring prior to February 3rd, 2000, or after February 2nd, 2001,
<br />unless said bond is extended. This bond may be extended annually thereafter upon the sole discretion of the
<br />surety by virtue of filing an extension Rider at least Thirty (30) day .prior to the expiration of this bond.
<br />1N WITNESS WHEREOF, said Principal and Surety have caused these presents to be duly signed and
<br />sealed this 1 sr day of February, 2000.
