B. Liquidated Damages. In the eventthat the Contractor fails to perform fully any of the Contractor's obligations under this Agreement (other than "Events of Default" stipulated in Article 11.2) the Contractor shall be in breach ("Event of Breach") of this Agreement Upon delivery of written notice to the Contractor, the City may impose the following liquidated damages upon the Contractor, in addition to any other available remedies the City may have: Payment per Occurrence i. Reliability a. For each failure to commence service to a new Customer account within seven (7) days after order received by $150 Contractor: b. For each failure to collect Solid Waste, Recyclables, and $150 Green Waste which has been properly delivered for collection, from an established Customer account on the scheduled collection day: ii. Quality c. For each occurrence of failure to properly return empty Solid Waste, Recycling or Green Waste Containers to avoid pedestrian or vehicular traffic impediments or to place cans upright with lids secured: $150 d. For each occurrence of excessive noise: $150 e. For each occurrence of discourteous behavior: $150 f. For each failure to immediately clean up material spilled from the Contractor's vehicles, Solid Waste, Recycling or Green Waste Containers: $150 g. For each occurrence of collecting Solid Waste, Recyclables or Green Waste during unauthorized hours: $150 h. For each failure to respond to a Customer complaint within one business day of receipt: $150 i. For each failure to have collection workers dressed in suitable and acceptable uniform clothing and identification badge (per employee per day): $150 j. For each failure to remedy a complaint which is found to be justified by the City Representative within forty-eight (48) hours after notification by the City Representative (each day): $100 k.
