ARTICLE 1. DEFINITIONS <br />For purposes of this Agreement the following words or phrases shall have the following meanings. To the <br />extentthatthese definitions differ from those found in the San Leandro Municipal Code, these definitions shall <br />prevail in such event <br />Act "Act" means the California Integrated Waste Management Act of 1989 (Division 30 of the <br />California Public Resources Code), as amended, supplemented, superseded and replaced from time <br />to time. <br />Agreement "Agreement" means this Franchise Agreement between the City and the Contractor for <br />Solid Waste, Recyclables and Green Waste Services including all exhibits and anyfuture amendments <br />hereto. <br />Applicable Law "Applicable Law" means all laws, regulations, rules, orders, judgments, decrees, <br />permits, approvals, or other requirement of any governmental agency (including the City) having <br />jurisdiction over the collection and disposition of Solid Waste, Recyclable Materials and Green Waste <br />that are in force on the Effective Date and as they may be enacted, issued or amended during the term <br />of this Agreement. <br />Backyard Services "Backyard Services" means collection services to residential Customers who (i) <br />request and are charged for services greater than Curbside Service or (ii) qualify without charge for <br />such greater service due to handicap, age or infirmity as defined herein. <br />Bin "Bin" means a container provided by the Contractor having a capacity equal to or less than ten <br />(10) cubic yards that is serviced using a front end loading vehicle. <br />Bulky Waste "Bulky Waste" includes, but is not limited to discarded materials such as large <br />household appliances, furniture, tires, carpets, mattresses, tree trunks, and similar large items which <br />require special handling due to their size. <br />Cart "Cart" means a receptacle for disposal of Solid Waste, Recyclables, or Green Waste in a range <br />of approximate sizes of 20, 32, 65 or 95 gallons with wheels, a handle for ease of movement and a <br />tight-fitting, attached lid, and designed to be dumped mechanically into a Solid Waste, Recyclable, or <br />Green Waste collection vehicle by Automated Curbside Service. <br />CERCLA "CERCLA" means the Comprehensive Environmental Responsibility Compensation and <br />Liability Act, 42 U.S.C.A. §9601 of seq., as amended or superseded, and the regulations promulgated <br />thereunder. <br />Change in Law "Change in Law" means any of the following events or conditions which have a <br />J:\wpd~stafl\akm\frenchisenew2.wpd 02/01/00 Page 2 of S9 <br />
