<br />finding that the Subconsultant is in violation of regulations issued by the <br />Secretary of Housing and Urban Development, 24 C.F.R. 135. Contractor will <br />not subcontract with any Subconsultant where it has notice or knowledge that the <br />later has been found in violation of regulations under 34 C.F.R. 135 and will not <br />let any subcontract unless the SubconsuItant has firs provided it with a <br />preliminary statement of ability to comply with the requirements of these <br />regulations. <br /> <br />7. LEAD-BASED PAINT <br /> <br />Consultant agrees that all rehabilitation or construction of residential structures with <br />assistance provided under this contract shall be subject to HUD Lead-Based Paint <br />Regulations at 24 CFR 570.608, and 24 CFR Park 35, and in particular Sub-Part B <br />thereof. Such regulations pertain to all HUD-assisted housing and require that all <br />owners, prospective owners, and tenants of buildings constructed prior to 1978 be <br />properly notified that such properties may include lead-based paint. Such notification <br />shall point out the hazards of lead-based paint and explain the symptoms, treatment and <br />precautions that should be taken when dealing with lead-based paint poisoning. <br /> <br />8. SECTION 504-PROGRAM ACCESSIBLITY <br /> <br />(a) General Prohibition Against Discrimination <br /> <br />No qualified individual with a handicap shall, solely on the basis of handicap, be <br />excluded from participation in, be denied the benefits of, or otherwise be <br />subjected to discrimination by a Consultant receiving Federal assistance as part of <br />the CDBG program. <br /> <br />1. Specific Prohibitions Against Discrimination <br /> <br />A Consultant who receives Federal assistance as part of the CDBG <br />Program, in providing any service, benefit, aid or housing may not, <br />directly or through contractual, licensing, or other arrangements, solely on <br />the basis of handicap: (a) deny; (b) afford unequal treatment; (c) provided <br />ineffective service, benefit, aid or housing; (d) provide different service, <br />benefit, aid or housing; or (e) limit the enjoyment of any right, privilege, <br />or advantage, to a qualified individual with handicaps the opportunity to <br />participate in, or benefit from, the service, benefit, aid or housing; <br /> <br />(b) Provisions Regarding Communications With Individuals With Handicaps <br /> <br />A Consultant who receives Federal assistance as part of the CDBG program shall <br />take appropriate steps to ensure effective communication with customers, clients, <br />and other members of the public.
