<br />San Leandro City Clerk <br />835 East 14th Street <br />San Leandro, CA 94577 <br />August 2, 2006 <br /> <br />Dear Sir or Madam, <br /> <br />Weare writing to express our desire to appeal the Board of Zoning Adjustments' decision <br />to proceed with the project currently scheduled to be built at 2888 Darius Way. <br /> <br />, <br />We feel strongly that a compound of this size does not blend in with the current design of <br />homes in the Bay-O- Vista area. At the BZA meeting, the architect indicated that the <br />owner plans to exceed the current restriction of 10 adults living in a single-family <br />dwelling and will attempt to get a variance to allow up to 20 adults to live there. Since <br />the area is not near to any public transportation, this could suggest that up to 20 cars may <br />need to be parked on the premises at any given time, not including visitors. <br /> <br />We feel that by allowing these structures to be built, a precedent will be set which will <br />allow more homes of this size to be built, or existing homes to be added-on, with no <br />regards to the current height restriction of 18 feet. Opinions regarding interference with <br />cunent neighbors' views were discussed among the Board, however, no one on the Board <br />visited existing homes prior to or after the meeting to actually see how the views were <br />affected. <br /> <br />Of particular concern to us is the integrity of the hill behind our home. As discussed at <br />the meeting, our swimming pool is about 10 feet from the edge of the hill. In 1964 when <br />the house was built, the pool was about 20 yards from the edge of the bill. Upon <br />acquisition of the property at 2888 Darius in 1989, the contractor removed a huge <br />portion of the hill, leaving us feeling vulnerable to slides every winter. We are very <br />concerned that further digging into the hill will cause catastrophic slides. <br /> <br />We were extremely disappointed in the Board's approval oftbis property.
