<br />MINUTES NO. 89-22 <br /> <br />Page 4 of 7 <br /> <br />November 9, 1989 <br /> <br />Vitz: General condition should be to keep Darius Way clean. It will be the only <br />access to this area. <br /> <br />Len Martinez. 1734 Darius Way: Stated the homes build on Lots 1, 2 and 3 will <br />eliminate his view and asked what the law states concerning protection of an <br />existing homeowner's view. <br /> <br />Riback: Stated that the City of San Leandro does not have a view ordinance. <br />Un 1 ess there is a pri vate vi ew easement on subject property, you have no <br />protection under the law. <br /> <br />Martinez: Asked if there was any way he could find out if or how much the houses <br />will block his view. <br /> <br />Reed: Asked Mr. Martinez if he has met wi th the buil der and stated that <br />sometimes those issues can be worked out directly with the developer. <br /> <br />Patton: The grading plans show a 247 foot elevation for Lot 1 and 243 feet for <br />Lot 2 which would indicate a range of 25 feet elevation difference between the <br />Martinez home and Lot 3. A single story home would be 16 feet and a two-story <br />home would be 21-22 feet in height. <br /> <br />Martinez: Asked if we can prohibit the developer from adding a second floor. <br /> <br />Vitz: Said there is no limitation in the Zoning Code for adding a second story <br />if they meet the set back requirement. However, a condition could be added to <br />limit the height of the homes on the subject lots. <br /> <br />Martinez: Also stated his concerns about keeping the street clean while <br />construction is in progress and also concerned about security during <br />construction. Asked if a night security guard could be obtained for the site. <br /> <br />Dluaosh: Asked Staff about the finished height of the homes on Lot 1 and 2. <br />Asked Mr. Martinez how he felt about his view being only partially blocked and <br />if he thought it would have an impact on his property. <br /> <br />Martinez: Stated he felt even a partial blockage of his view would have a <br />negative impact on his property value. <br /> <br />Beckencourt: Stated concerns about possible drainage problems. <br /> <br />Jim Rob. 2011 Howe Drive: Asked what is going to happen to the fill on the <br />downhill side of Lot 4. Is the developer going to put in a retaining wall and <br />how will drainage be handled. <br /> <br />Vitz: It is the responsibility of the developer to retain all the fill on his <br />own property and not cross anybody else's property unless he has appropriate <br />easement. It appears that no retaining wall will be necessary and no problems <br />are anticipated. <br /> <br />Nelson: Stated that, if anything, drainage will be improved because currently <br />
