Cooke, Principal Engine~~ <br /> <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br /> <br />RESOLUTION AMENDING TITLE 6 CHAPTER 4 OF THE SAN LEANDRO <br />ADMINISTRATIVE CODE RELATED TO GENERAL ENCROACHMENT FEES FOR <br />NEWS RACKS IN THE CITY <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />It is recommended that the San Leandro Administrative Code's fee schedule be amended to <br />include encroachment permit fees and deposits for newsracks in accordance with Municipal <br />Code Chapter 5-6 Newsrack Regulations. <br /> <br />BACKGROUND <br /> <br />Analvsis <br /> <br />Chapter 5-6 of the San Leandro Municipal Code outlines the City's regulations concerning <br />newsracks. Section 5-6-205(e) states that the City shall collect "a non-refundable fee, in the <br />amount established by resolution or ordinance of the City Council". This fee will cover <br />administrative staff time for permit review and issuance. <br /> <br />Section 5-6-1 05( a) provides for the collection of a deposit. The section states that along with the <br />permit application, a refundable deposit shall be deposited in the amount established by the <br />Engineering and Transportation Director, which may be used by the City as provided in Article 6 <br />of Chapter 5 and/or refunded within 30 days of expiration, non-renewal, or revocation of the <br />permit. Section 5-6-625 defines how the deposited funds may be used by the City. If the City <br />uses the deposited funds to perform repairs or maintenance or to remove the newsrack, the <br />newsrack operator must replenish the deposit to the full amount within 30 days. <br /> <br />Current City Council Policy <br /> <br />None <br />
