<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2006-129 <br /> <br />(1049/2318) <br /> <br />RESOLUTION AMENDING TITLE 6 CHAPTER 4 OF THE <br />SAN LEANDRO ADMINISTRATNE CODE RELATED TO <br />GENERAL ENCROACHMENT FEES FOR NEWSRACKS IN THE CITY <br /> <br />WHEREAS, Chapter 5-6 of the San Leandro Municipal Code allows for payment of a non- <br />refundable fee and deposits for newsracks. <br /> <br />WHEREAS, it is recommended that an encroachment permit fee be charged and deposit <br />collected. <br /> <br />WHEREAS, the Council is familiar with the contents thereof. <br /> <br />WHEREAS, the City Manager has recommended approval of said amendment. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br /> <br />Section 1 That Title 6, Chapter 4, Section 6.4.100 of the San Leandro Administrative <br />Code is amended to add a fee as follows: <br /> <br />ENGINEERING AND TRANSPORTATION DEPARTMENT <br />1. General Encroachment <br />1. Newsrack Permit <br />Maintenance Deposit <br /> <br />$55.00 + $5.50 per newsrack <br />$100.00 + 5.00 per newsrack <br /> <br />Section 2 The provisions of this resolution shall be effective immediately, and the fee <br />will become effective on January 1, 2007. <br /> <br />Introduced by Councilmember Santos and passed and adopted this 4th day of December <br />2006, by the following called vote: <br /> <br />Members of the Council: <br /> <br />AYES: Councilmembers Badger, Grant, Nardine, Santos, Starosciak, Stephens; <br />Mayor Young (7) <br /> <br />NOES: None (0) <br /> <br />ABSENT: None (0) <br /> <br />ATTEST: <br /> <br />~~~ <br /> <br />Marian Handa, City Clerk <br />
