<br />CITY OF SAN LEANDRO <br />STAFF REPORT <br /> <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br /> <br />rV <br /> <br />J 0 ~ ermanis <br />Ct{ll.1:anager <br /> <br />DATE: <br /> <br />December 4, 2006 <br /> <br />TO: <br /> <br />SUBJECT: <br /> <br />John Jermanis, City Manager <br /> <br />Marian Handa, City Cler~ <br /> <br />MATTER OF DISCUSSION OF APPOINTMENT PROCESS FOR FILLING CITY <br />COUNCIL DISTRICT 6 VACANCY <br /> <br />FROM: <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />It is recommended that the City Council discuss the process for filling the District 6 Council vacancy <br />created by the election of District 6 City Councilmember Tony Santos as Mayor. <br /> <br />BACKGROUND <br /> <br />Current District 6 City Councilmember Anthony B. "Tony" Santos was elected Mayor in the <br />November 7, 2006 Special Election. When Mr. Santos assumes the office of Mayor on January I, <br />2007, he will vacate his position as District 6 City Councilmember. <br /> <br />Section 250 of the City Charter provides for filling a Council vacancy by appointment by the Council. <br />The Council has sixty days after the existence of the vacancy in which to make the appointment. If the <br />Council fails to fill the vacancy within sixty days, it must call a special election. <br /> <br />Council vacancies have traditionally been filled by Council appointment. The Council could, at its <br />December 4, 2006 City Council Meeting, declare its intention to appoint someone to fill the upcoming <br />District 6 Council vacancy and direct staff to provide public notice of the vacancy and application <br />process. <br /> <br />ELIGIBILITY AND APPLICATION <br /> <br />Interested persons would be invited to submit an application for consideration. A sample application <br />form is attached. To be considered for appointment, applicants must be registered voters residing in <br />District 6 on the date of the appointment and for 30 days immediately preceding the appointment. <br />After the close of the application period, copies ofthe applications would be forwarded to the Council. <br /> <br />SCREENING <br /> <br />The Council could determine the number of applicants to be interviewed. Staff suggests limiting the <br />number of interviews to four or five. In the event more applications are received than the number of <br />
