<br />MINUTES Page 2 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Special Meeting-July 10, 2006 <br /> <br />Harold Perez, San Leandro resident, addressed the City Council regarding a variety of tree <br />with invasive roots that is damaging the sidewalk and sewer in his neighborhood. Mr. Perez <br />described continuing problems with a neighbor. <br /> <br />3. CITY MANAGER AND CITY ATTORNEY REPORTS AND COMMENTS <br /> <br />City Manager Jermanis commented on the changing social environment and increasing use of <br />foul language as described by Mr. Henriques. He noted that the attempt to limit the use of <br />foul language may be viewed as limiting the right to free speech. <br /> <br />Regarding Mr. Filipovich's comments, Mr. Jermanis noted that it has been the Council's <br />practice to provide members of the community the opportunity to speak at its public meetings, <br />rather than to engage in dialogue with the Council. <br /> <br />In response to Mr. Perez's comments, Mr. Jermanis acknowledged that staff is aware of the <br />damage to property caused by street trees and asked Mr. Perez to provide him with the <br />location of the tree in question. He outlined the Council's policy for sharing the cost of <br />sidewalk repairs for damage caused by street trees and noted that the City does not have <br />adequate funds to perform all needed repairs. <br /> <br />In the absence of City Attorney Jayne Williams, Assist City Attorney Stephanie Stuart was <br />present. Ms. Stuart addressed the issue of inappropriate language, stating that the City <br />Attorney's Office could prepare an opinion on the legality of adopting an ordinance regulating <br />the use of foul language if the Council so desires. <br /> <br />4. AMENDMENT OF CONSENT CALENDAR <br /> <br />City Councilmembers or staff have an opportunity at this time to request that an item be <br />removed from the Consent Calendar for the presentation of a staff report or other special <br />consideration. Members of the Public may request the opportunity to address the City <br />Council regarding items remaining on the Consent Calendar by filling out a speaker card and <br />submitting it to the City Clerk prior to the calling of Item 4, Amendment of Consent <br />Calendar. Items remaining on the Consent Calendar will be considered for approval under <br />one motion. <br /> <br />Public Comments on the Consent Calendar: <br /> <br />Charles Gilcrest, San Leandro resident, addressed the City Council regarding Consent <br />Calendar Item 5.F. Mr. Gilcrest suggested that the contract for the Housing Rehabilitation <br />Program go out to competitive bid next year to give the Davis Street Family Resource Center <br />the opportunity to submit a proposal and to ensure the best use of City funds through the <br />bidding process. <br />
