MINUTES Page 2 City of San Leandro City Council and San Leandro Redevelopment Agency Joint Special Meeting-July 10, 2006 Harold Perez, San Leandro resident, addressed the City Council regarding a variety of tree with invasive roots that is damaging the sidewalk and sewer in his neighborhood. Mr. Perez described continuing problems with a neighbor. 3. CITY MANAGER AND CITY ATTORNEY REPORTS AND COMMENTS City Manager Jermanis commented on the changing social environment and increasing use of foul language as described by Mr. Henriques. He noted that the attempt to limit the use of foul language may be viewed as limiting the right to free speech. Regarding Mr. Filipovich's comments, Mr. Jermanis noted that it has been the Council's practice to provide members of the community the opportunity to speak at its public meetings, rather than to engage in dialogue with the Council. In response to Mr. Perez's comments, Mr. Jermanis acknowledged that staff is aware of the damage to property caused by street trees and asked Mr. Perez to provide him with the location of the tree in question. He outlined the Council's policy for sharing the cost of sidewalk repairs for damage caused by street trees and noted that the City does not have adequate funds to perform all needed repairs. In the absence of City Attorney Jayne Williams, Assist City Attorney Stephanie Stuart was present. Ms. Stuart addressed the issue of inappropriate language, stating that the City Attorney's Office could prepare an opinion on the legality of adopting an ordinance regulating the use of foul language if the Council so desires. 4. AMENDMENT OF CONSENT CALENDAR City Councilmembers or staff have an opportunity at this time to request that an item be removed from the Consent Calendar for the presentation of a staff report or other special consideration. Members of the Public may request the opportunity to address the City Council regarding items remaining on the Consent Calendar by filling out a speaker card and submitting it to the City Clerk prior to the calling of Item 4, Amendment of Consent Calendar. Items remaining on the Consent Calendar will be considered for approval under one motion. Public Comments on the Consent Calendar: Charles Gilcrest, San Leandro resident, addressed the City Council regarding Consent Calendar Item 5.F. Mr. Gilcrest suggested that the contract for the Housing Rehabilitation Program go out to competitive bid next year to give the Davis Street Family Resource Center the opportunity to submit a proposal and to ensure the best use of City funds through the bidding process.
