EAST BAY REGIONAL PARK DISTRICT RESOLUTION NO.: 2006 -6- 144 Tuesday, June 21,2006 AUTHORIZATION FOR SOLE SOURCE PURCHASE OF HERBICIDE FOR CONTROL OF INVASIVE SPARTINA WHEREAS, the District in partnership with the California Coastal Conselilancy and the Invasive Spartina Project is working to eradicate invasive Spartina from shoreline parks; and WHEREAS, the threat of invasive Spartina to California's wetlands has created intense demand for "Habitat" herbicide; and WHEREAS, BASF the sole manufacturer of "Habitat" herbicide has made it an "agency product"; and WHEREAS, the Wilber Ellis Company, Rio Linda, CA acting as the agent for BASF is the sole source of "Habitat" herbicide to the District; and WHEREAS, Staff plans to purchase 260 gallons of "Habitat" herbicide along with the surfactant "Cbmpetitor" for $81 ,366.10 for the treatment of invasive Spartina this fall; and WHEREAS, all purchases in excess of $25,000 require bidding, except when a sole source is available, and approval by the Board of Directors; NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of the East Bay Regional Park District hereby confirm and authorize the sole source purchase of 260 gallons of "Habitat" herbicide along with the surfactant "Competitor" from Wilber Ellis Company, Rio Linda CA for a price of $81,366.10, to be funded from capital project account number 336-7465-000-5124-507304-371; and BE IT FURTHER RESOLVED, that the General Manager is hereby authorized and directed, on behalf of the District and in its name, to execute and deliver such documents and to do such acts as may be deemed necessary or appropriate to accomplish the intentions of this resolution.
