The Statement lists the final tally of votes received by each
candidate as detemlined by the Official Canvass perfonned by the ROV of the returns of all
votes cast in the City of San Leandro. The City Council is requested to adopt the attached
resolution declaring the results of the Election.

BACKGROUND

The Charter of the City of San Leandro requires a successful candidate for elective office to
receive at least 50% plus one of the votes cast for that office. In the event that no candidate
receives 50% plus one of the votes cast for that office, the Charter requires the City Council to
provide for a run-off vote to detennine the person elected. In the June 6, 2006 General
Municipal Election, no candidate for Mayor and no candidate for City Council District 3
received the required 50% plus one votes cast for those offices to win the election.

On July 17, 2006, the City Council adopted Resolution No. 2006-093, calling a Special
Municipal Run-Off Election, to be held on November 7, 2006, among the two persons receiving
the highest number of votes for the office of Mayor and among the two persons receiving the
highest number of votes for the office of City Councilmember, District 3, in the June 6, 2006
General Municipal Election. It was also requested that the Board of Supervisors pennit the
consolidation of the City's Special Municipal RunofI Election with the Statewide General
Election, and that the ROY provide necessary services rclated to the conduct of the election.
