DRAFT MINUTES Page 6
City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-December 4, 2006

house to another site would require more grading work and resulting geological issues.
The Applicant opted instead to reduce the height of the house. Mr. Schock pointed out
that the slope of the hillside in the area indicated by Councilmember Santos is steeper
and has a cross slope. Ms. Barros added that after the application was filed last year, the
site was reviewed and the location of the pads and the turnaround was finalized with the
consultation and approval of the Fire Department. Ms. Barros clarified that the au pair
suite, originally intended for the Applicant's sister, has been converted into
uninhabitable space.

Councilmember Starosciak inquired about the increase in the footprint of the main
house. Architect Stephen Glaudemans described the changes to the design which
resulted in the increased footprint ofthe house. Councilmember Starosciak asked about
the requirement that no heritage trees or shrubs are to be planted. Mr. Hom commented
that the uphill neighbors had expressed concern that no large trees or shrubs be planted
which would further block their view of the Bay. Based on discussions with the
Applicant, any vegetation that is planted will not exceed 18 feet in height. Mr. Horn
noted that residents will have the opportunity to review the landscape plans.
Councilmember Starosciak noted it was suggested that the Applicant meet with the
neighbors, and that did not happen. She asked how the Council could be assured that
the landscape plan review with the neighbors would happen. Mr. Hom indicated that
staff will ensure that the landscape plan review will occur during the building penuit
process. Councilmember Starosciak asked if the soils report gives any evidence of
"creep" of the hillside. Mr. Schock stated that both an aerial reconnaissance and field
survey were performed by the soils engineer, specifically to look for evidence of creep
or slides. Mr. Schock indicated that there are some specific recommendations in the
soils analysis for import and compaction of soils to address the issue of creep, which
staffwill ensure happens as part ofthe review process.

Councilmember Nardine pointed out that in 1989, Mr. Langon had expressed concern
regarding the drainage on the lot ifit remained vacant, and she asked if there have been
any drainage issues on the site. Mr. Schock indicated that there were site drainage
features installed after 1989, and there have been no drainage issues to his knowledge.

Vice Mayor Grant commented that she walked the proposed site. She pointed out a
discrepancy between the revised roof height of 28 feet listed in the staff report and the
average roof height of 26 feet listed in the Revised Recommended Conditions of
Approval. Ms. Barros indicated that the correct roof height should be 28 feet. Vice
Mayor Grant asked if the Conditions of Approval address large satellite dishes. Ms.
Barros stated that nornlal-sized satellite dishes are under the jurisdiction of the FCC.
Vice Mayor Grant pointed out that there is a huge satellite dish on another property in
Bay-O- Vista, and she expressed concern that this homeowner may also desire one. Mr.
Hom noted that there are legal issues around what the City can regulate with regard to
satellite dishes. City Attorney Williams stated that while there are limitations to the
City's ability to regulate satellite dishes, there are opportunities for the City to regulate
them if they obstruct views or if they pose health and safety issues. Vice Mayor Grant
commented that the proposed home would not be out of scale with the existing homes.

6
