<br />A TT ACHMENT C <br /> <br />Exct'rpl of Approved Minutes - J2/7/(}6 Board a/Zoning Adjustments Meeting <br /> <br />J <br /> <br />Item 6: Public Hearing <br />(a) Matter of consideration of amendments to the Zoning Code, including: Article 5, <br />adding new Section 2-537 Daylight Plane; Article 5, adding new Section 2-539 Maximum <br />Floor Area Ratio (FAR); Article 5, amending Section 2-584; and amending Article 17, <br />Section 4-1794 related to off-street parking requirements. In addition, Article 24, Section <br />5-2424 is proposed for amendment to allow condominium conversions for four (4) <br />residential units or less to be approved administratively by the Zoning Enforcement <br />Official. <br /> <br />Planning Manager Pollart summarized the joint work sessJOn held in October with the <br />Planning Commission and BZA, which resulted in the above consideration based upon <br />comments received during the work session. She stated that most of these amendments had been <br />prompted by the Darius Court home that would have been in excess of 6,800 square feet, not <br />including garages. <br /> <br />. Height for garden features in the RS- VP District. <br /> <br />She displayed a recently constructed gazebo that was more than 12 feet tall and <br />obstructed the rear neighbor's view of the bay. Site Plan Review and Minor View <br />Preservation would be needed for a garden feature that was more than 120 square feet or <br />more than 10 feet tall. Adjacent neighbors would be notified and would be able to review <br />the plans. The Zoning Enforcement Official would make the decision. <br /> <br />. Daylight Plane <br /> <br />This new section would be applicable in the RS,RS-40, RS-VP, RD and the RO <br />Districts. It would deal with privacy and shadows on neighboring residential properties. If <br />the Daylight Plan Requirement was not met, the applicant would have to apply for an <br />exception for administrative review by the Zoning Enforcement Official. A graphic was <br />displayed that would become a part of the Zoning Code. <br /> <br />. Maximum Floor Area (FAR) <br /> <br />Establishing a maximum FAR would be another way of addressing large homes in <br />context of the neighborhood or streetseape. If the FAR was to be exceeded, a major site <br />plan review would be required, which would include a noticed, public Zoning <br />En[orcement Official hearing. A table was displayed showing the various F ARs that <br />would be approved within the city. Any residence over 4,000 square feet would require a <br />major site plan review by the BZA. Also, with multiple units on a single lot, if the <br />cumulative square feet was more than 6,000 square feet, a major site review by the BZA <br />would be required. She asked for ICedback about the BZA doing major site plan reviews. <br /> <br />. Parking <br /> <br />In the past, when applications [or condominium conversions had come before the Board <br />in the RO District, the neighbors had expressed concern about the additional parking. <br />Currently, the RO parking requirements were less than other residential areas.
