<br />J\HNUTES Page 14 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-November 15, 2004 <br /> <br />Mr. J ermanis indicated that, based on a concern expressed by Councilmember Santos <br />regarding the exclusion of the South Field Study Group, he contacted Steve Grossman of the <br />Port. Mr. Grosslnan informed Mr. J ermanis that it was always the intent of the Port to <br />n1aintain both the North and South Field research groups, and there would be no problem in <br />adding language in the agreelnent to reflect that intent. <br /> <br />Councilmember Grant asked whether the Port would be open to considering minor changes to <br />the agreement at this stage. Mr. J ern1anis indicated that the attorneys for the City and the Port <br />have spent several sessions discussing the language in the agreement. <br /> <br />Ms. Ornelas suggested that striking the word "information" as suggested by Councilmember <br />Nardine could be accon1plished. She noted that it was the FAA's idea to add the second ILS <br />to Runway 27 Left, and presun1ably it would not have recommended it if it was not safe to do <br />so. <br /> <br />Councilnlen1ber Grant asked why the representative from the FAA stated at the Committee <br />meeting that the second ILS was problen1atic. Ms. Ornelas noted that it would depend on <br />how the second ILS is used, and the intent of the agreement is to work closely with the FAA <br />and the North Field Research Group to identify the best and safest use for the second ILS. <br /> <br />Counciln1en1ber Santos commented that at the last Airport Committee Ineeting, the FAA <br />stated it will not move the ILS fronl 27 Right. If the Council returns this item to the <br />COll1111ittee for further refinement, the City will not receive the benefits provided by the Port <br />in the addendum. Councilmelnber Santos noted that the following language will be added to <br />the addendmn: "The Port shall continue the South Field Research Group and will continue to <br />work in good faith with the Cities of San Leandro and Alameda to address the noise issues <br />that result fronl the South Field operations." <br /> <br />Councihnen1ber Glaze requested clarification about moving the ILS from 27 Right. Mr. <br />J ermanis clarified that the original agreement in 2000 called for the ILS to be moved from 27 <br />Right to 27 Left, and the an1ended agreement states that the FAA and the Port will either <br />detem1ine that it is feasible to install a second ILS at 27 Left, or do nothing. <br /> <br />City AttoDley J aYlle WilliaIns stated that the 2000 Settlement Agreement requires the ILS to <br />be moved fron1 27 Right to 27 Left. However, under federal law, the FAA preempts local <br />jurisdictions. Ms. Williams noted that attelnpting to enforce the move of the ILS could be <br />preelnpted by the FAA. <br /> <br />Councilmelnber Glaze asked for the gist of the agreement. Mr. J ermanis stated that the ILS is <br />located at 27 Right and will remain there. The City is agreeing with the Port to allow it to <br />work with the FAA to explore the feasibility of adding a second ILS to runway 27 Left. <br />Councilmember Glaze noted that the Port and FAA have a very cooperative agreement and <br />expressed doubt that the two entities would act for the benefit of the City. Mr. J erm ani s <br />stated he believes there is a good chance that they will install a second ILS at 27 Left since the <br />FAA has offered to pay for it. <br />
