<br />l\lINUTES Page 6 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-December 6, 2004 <br /> <br />Vice Mayor Badger asked if this is a protest vote. Mr. Whitnell clarified that only the <br />votes which are submitted are counted to detennine whether there is a majority protest. <br />Since all the votes received were in favor, there is no majority protest, and the Council <br />can proceed to fonn the district if it chooses. <br /> <br />Coul1cihllember Grant expressed concern that due to confusion regarding the cost of the <br />project, she would like to have the opportunity to have the residents' questions <br />addressed. <br /> <br />Councilmen1ber Santos expressed assurance that he and City Manager Jelmanis have <br />spoken to all the residents on Walnut Drive, and five of the residents have expressed <br />support for the aSSeSS111ent district. <br /> <br />Mayor Young suggested that, even though the Council could take actjon tonight to form <br />the district, it \vould make sense to continue the Public Hearing to allow staff to meet <br />with the residents and resolve any ren1aining issues, and there would be no harm in <br />doing so. <br /> <br />Councilnlen1ber Santos suggested continuing the Public Hearing on this lnatter to <br />January 3,2005. Mayor Young asked if the Public Hearing would need to be reopened <br />on that date. Mr. Whitnell stated that if the Council wishes to allow the residents <br />additional tilne to subnlit ballots, the Public Hearing would need to be reopened on <br />January 3. <br /> <br />Minute Order No. 2004-039, Motion to Continue the Public Hearing for the <br />Establishn1ent of ASSeSSlTIent District No. 2004-1 (Walnut Drive) to January 3, <br />2005. (3033) <br /> <br />The City Council moved to continue the Public Hearing for the establishment of <br />Assessment District No. 2004-1 (Walnut Drive) to January 3, 2005. <br /> <br />l\1/S/C Santos and Badger. Matter of an Interinl Urgency Ordinance Prohibiting Consideration and Approval of <br />Use Pen11its, Variances, Building Permits, Start of New Construction, or Other <br />Entitlenlents for Any New Medical Marijuana Dispensaries Within the City for a <br />Forty-Five Day Period (places a ten1porary moratoriUlTI on the approval of any <br />plalu1ing approvals, building permits, or other entitlen1ents that are necessary for <br />establishn1ent of any new medical marijuana dispensaries in the City). <br /> <br />This being the tin1e and place for the Public Hearing on the above matter, City Manager <br />J elmanis gave an overview of the item and introduced Plam1ing Manager Debbie <br />Pollart. Ms. Pollart gave background on the lnatter and the reconlnlendation for <br />Council consideration. <br /> <br />The Healing \vas then opened to the Public. <br />
