Resolution No. 2003-248~ Resolution Approving Agreement between City of San <br />Leandro and San Leandro Unified School District for the Improvement and Recreational <br />Use of Farrelly Complex (approves a new 10-year joint use agreement for development <br />installation, construction, and maintenance of the Farrelly Complex for cOll1lnunity <br />recreation activities). (1001/2983) <br /> <br />9. ITEMS REMOVED FROM CONSENT CALENDAR <br /> <br />Public comments are limited to 3 minutes per person per item. <br /> <br />8.1. Resolution No. 2003-249, Resolution Authorizing the Extension of a Sublease <br />Agreement with Trans-Box Systems, Inc., for the Airspace under the Davis Street <br />Overcrossing at Beecher Street (provides for a 5-year extension of the 10-year sublease <br />agreement Lease Area No. 04-ALA-112-I per the original sublease agreement). (2138) <br /> <br />City Manager J ermanis gave an overview of the item and introduced Engineering and <br />Transportation Director Uche Udemezue. Mr. Udemezue gave additional details on the <br />agreement, noting that the revised agreement will provide the City with additional <br />controls and authority as well as a cancellation provision. <br /> <br />Vice Mayor Glaze cOlnmented that the amount charged for the space seems very low. <br />Mr. Udemezue noted that since the original agreenlent was for $300 per month, the <br />$350 is the maximum amount the City can charge. <br /> <br />Councilmember Santos asked if staff has inspected the condition of the property to <br />ensure the terms of the agreement are being met. Mr. Udemezue stated Trans-Box is <br />generally nleeting the terms of agreement. Councihnember Santos asked for and <br />received clarification that the agreement will allow the City to inlpose certain conditions <br />on the lessee. <br /> <br />Councilmember Badger related concerns from residents regarding trucks being double- <br />parked as they exit Costco. He stated he hoped Trans-Box understands that failure to <br />comply with the ternlS of the agreement would put any future contract in jeopardy and <br />that the Police Department steps up enforcement of the parking issues. <br /> <br />Councilmenlber N ardine asked how the City could modify other ternlS of the lease but <br />not the lease amount. Mr. Udemezue noted the language in the lease specifies that the <br />fee increase be tied to the CPr. <br /> <br />Mr. J ermanis noted Caltrans allows the City to control the use of the property under the <br />freeways, and the City has determined leasing to adjacent businesses to be the best <br />option. The renewal of this lease gives the City the opportunity to improve upon the <br />situation and address some of the concerns with the existing lease. <br />
