<br />MINUTES <br />City of San Lcandro City Council Meeting-October 7, 2002 <br /> <br />Page 3 <br /> <br />Council Member Badger not cd that, at the time of permitting, the applicant needed to <br />undcrstand the conditions during the BZA process and asked why he does not understand <br />the conditions now. Mr. Wasserman commented that the original permit was granted in <br />1993 and that some changes have occurred since that time. Council Member Badger <br />noted that, if the conditions had changed, the applicant had the right to come back. He <br />asked how this matter had come to this point. <br /> <br />Council Member Grant noteel the appellant's comment related to fairness in treatment <br />during the permitting process. Mr. Wasserman commented on the variety of discussions <br />with staff and the understandings being rcached about not meeting the conditions. He <br />said the record that was presented to the BZA was not complete and that he would like to <br />work with staffto clarify. <br /> <br />Council Member Loeffler noted the comment related to changes in the Planning <br />Department staff and providing consistent communication with applicants. Mr. <br />Wasserman stated direction had difCercd over time by staff, and he supported Option One <br />to work out the issues. <br /> <br />The Hearing was then opened to the public. <br /> <br />Wafaa Aborashed, Davis West Neighborhood Group, addressed the City Council on <br />her concel11 about a business operating while violating conditions and encouraged the <br />Council to deny a business license. <br /> <br />Lou Filipovich, 15376 Laverne Drive, addressed the City Council on the appeal process <br />and the costs of the process. I-Ic commcntcd on public patiicipation and process; he <br />encouraged the Council to uphold the BZA decision. <br /> <br />There being no further comments from the public, the Public Hearing was closed. <br /> <br />M/S/C Glaze and Nardine. Ayes: 7; Noes: 0 <br /> <br />Mr. Wasserman commented that the four neighboring businesses arc supportive of the <br />appellant. He commented on previous grading pel111it requirements and mentioned the <br />drainage issues involved actions by the Port of Oakland. He said the roadway had been <br />cleared and required signs had been installed but were later relllOved. He also felt the <br />BZA hearing was not properly noticed. <br /> <br />Council Member Badgerrequested the City Attorney's c1ari fieation on his voting position <br />due to his prior service on the BZA during the application process. <br /> <br />Council Member Nardine requested infornlation on the fence reimbursement issue, <br />monitoring time by staLl and the complaints registered regarding the emergency access <br />and fencing. <br />
