<br />lVlIN UTES <br />City or San Lcandro City Council Meeting-October 7, 2002 <br /> <br />Page 4 <br /> <br />City Manager J eml ani s summarized the actions taken to date and proposed that stalT meet <br />with the appellant to discuss the issues. <br /> <br />Council Member Santos commented on the issue going back to 1993 and the conditions <br />of approval related to the buildings and drainage. He questioned whether the business <br />owner should go through the pemlit process again. He believes the business owes the <br />City money for the fence. He commented on insurance requirements. <br /> <br />Council Member Grant stated she supports the three-month delay. She noted her <br />eoncems with previous Planning Department stall and stated that all safety-related issues <br />should be addressed illlinediately. <br /> <br />Vice Mayor Glaze commented that in 1996 the business was granted a six-month <br />extension and was later deemed in compliance. He requested the owner, Mr. Guss, to <br />come forward and address the City Council. <br /> <br />Mr. Guss commented on the length of time his business has been in San Leandro and his <br />eonmlitment to the community. He cited several projects in the City of San Leandro on <br />which he has served as contractor. He said he had five letters from neighbors in support <br />of his business. He noted that the dirt had been taken by Oakland for the golf course at <br />Galbraith, not the Port of Oakland. <br /> <br />Mayor Young asked about the type of businesses which may be permitted in the area. She <br />noted that something different could potentially move to the area. Ms. Pollart clarified 1G <br />zoning allowances. Mayor Young req uested clari fication from Mr. Guss as to the lype of <br />materials stored on site. <br /> <br />The lallowing Motion was then introduced: <br /> <br />Minute Order No. 2002-55, Motion to continue the Public Hearing lar CU-93-14 <br />f()r a period of three months to allow the City to reach an agreement with the appellant <br />for reimbursement of funds spent on the new fence, and to allow stalTtime to monitor <br />compliance. (1019/1 098) <br /> <br />The City Council made a motion to continue the Public Hearing for the appeal <br />by Jerry L. Guss on behalf of ~ & G Contractors, Inc. of the Board of Zoning <br />Adjustments' revocation of Conditional Use Permit CU-93-14; appeal by <br />applicant and others of the decision of the Board of Zoning Adjustments to <br />revoke CU-93-14 for the collection, storage processing and distribution of <br />concrete, asphalt and dirt at 2660 Eden Road; Assessor's Parcel Number 42- <br />4530-4; to a date uncertain but no sooner than three (3) months from the date of <br />this Public Hearing. The applicant is instructed to comply with all conditions or <br />to reach an agreement with staff as to proposed moditication(s) to the conditions <br />prior to the continued hearing date. <br /> <br />M/S/C Santos and Nardine.
