Ordinance No. 2002-028, ordinance rezoning certain property herein described as to <br />Zoning District and amending Zoning Map (PLN2002~00031) located at 2500 Davis <br />Street; Assessor's Parcel Number 79A-515-2-8. (1099/1 009/1 (24) <br /> <br />Public Comments: <br />Lou Filipovich, 15376 Laverne Drive, addressed the City Council regarding events <br />which took place at the July 30, 2002 City Council meeting. Mr. Filipovich expressed <br />concern certain details of the public hearing were not included in the published news <br />story, and he was told by the editor it was not published because he did not believe the <br />information had any value. Mr. Filipovich made reference to a report regarding <br />redevelopment within the subject area. <br /> <br />Adopted <br /> <br />M/S/C Santos and Nardine. Ayes: 5; Noes: 1 (Loeffler); Absent: 1 (Grant) <br /> <br />D. Report on Closed Session actions taken. <br /> <br />There was no Closed Session. <br /> <br />9. CITY COUNCIL COMMENTS <br /> <br />A. Council Member Badger reported he visited with second graders at Garfield School, and <br />spoke with a group of Explorers Ii-om all over the county. Council Member Badger was <br />very impressed with the Explorers, and would like to find a way to promote them and <br />their work. <br /> <br />B. Vice-Mayor G]aze noted the City docs not have a joint use agreement with A]ameda <br />County Flood Control, and pointed out there was a lot of damage to homes and streets and <br />time spent by City Public Works crews due to negligence by Alameda County Flood <br />Control. Vice-Mayor Glaze asked i [1) the City can bill [or their services due to Alameda <br />County Flood Control's failure to maintain their system, and asked what the process is [or <br />citizens' claims against Alameda County Flood Control for property damage; and 2) what <br />it would take to fonn a new district. City Manager Jem1anis o[fered to provide a report on <br />the extent of the damage from the recent flooding, look into what recourse citizens have - <br />for making claims for damage, and develop a proactive approach to managing the flood <br />control channel. City Attomey Randolph noted every public agency is required to have a <br />claims process. <br />
