PUBLIC HEARINGS <br /> <br />Public Hearing Comments are limited to 5 minutes per person. When you address the <br />City Council, you should fill out a speaker card and submit it to the City Clerk so the <br />order of speakers may be determined and an official record of names and addresses <br />obtained. <br /> <br />A Matter of Appeal bv Stephen G. Chandler. Attornev on Behalf of Bill's <br />Towin!!. ADDlicant. of the Board ofZonin!! Adiustments' Denial ofPLN2001- <br />00005; Conditional Use; to Modify an Existing Conditional Use Permit to Expand <br />an Existing Vehicle Storage Facility for Bill's Towing into Two Portions of Union <br />Pacific Railroad (UPRR) Right of Way. One Portion, the Primary Lot, is Located <br />Contiguous to the Current Business Location at 527 Harlan Street. The Second <br />Area is Located on the North Side of Harlan Street, Between Harlan Street and <br />Castro Street, Adjacent to 520 Harlan Street and 597 Castro Street. The Second <br />(UPRR) Right-of-Way Area Would Be Used for Short-Term Holding of Vehicles <br />While Arranging Vehicles in the Primary Lot (527 Harlan Street); Assessor's <br />Parcel No. 75-77-15 and Portions of75-77-18 and 33; W. Drew and D. R. Kraft, <br />Bill's Towing, Applicant and Property Owner of 527 Harlan Street; Union Pacific, <br />Property Owner ofUPRRRight of Way; II. Industrial Limited. <br /> <br />This being the time and place for the Public Hearing on the above matter, Hanson <br />Horn, Director of Development Services gave the overview of the appeal and <br />Elmer Penaranda, Planner I, gave a detailed summary of the appeal and the <br />recommendation :from the Board of Zoning Adjustments. <br /> <br />Stephen Chandler, Attorney on behalf of Bill's Towing (appellant), 1330 E. <br />14th Street, addressed the City Council and gave a history of the property in <br />question. Mr. Chandler stated it is unfair to prohibit full use of this property, as his <br />client needs extra space to maintain his business. <br /> <br />The Hearing was then opened to the public. <br /> <br />Butch Archuleta, San Leandro Towing, 25289 N. Gold Ridge Drive, Castro <br />Valley, addressed the City Council in support of upholding the denial of the <br />Appeal, and asked the City Council not to grant the conditional use permit to Bill's <br />T owing. They stated their concerns regarding the condition of the property and <br />indicated they feel it would be unfair to not require Bill's Towing to follow the <br />same guidelines that they have had to follow. <br /> <br />Lou Filipovich, 15376 Laverne Drive, addressed the City Council requesting that <br />the Press be pointed out to the public in attendance and that the Press should sit in <br />the appropriate designated area_ He further stated his opposition to the City's <br />Appeal Filing Fee of$160.00. <br />
