<br />Minutes - City of San Leandro City Council Meeting <br />May 21, 2001 <br /> <br />Page 3 <br /> <br />There being no further comments from the public, and without opposition, the <br />Public Hearing was closed. <br /> <br />City Council discussion ensued regarding how staff processed the application for <br />the conditional use pennit; concerns regarding parking on the street, fencing, and <br />the precedent setting nature of this issue, should the Council uphold the appeal. <br /> <br />Council Member Loeffler stated his view that the right-of-way needed to be <br />preserved and that he would be supporting the Board of Zoning Adjustment's <br />recommendation to deny the appeal. <br /> <br />Council Member Grant agreed and stated her support for the Board of Zoning <br />Adjustment's recommendation to deny the appeal. <br /> <br />Council Member Galvan stated his intent to deny the appeal, but to direct staff to <br />work with the contiguous property owner so as to come up with clear conditions <br />for a new application. <br /> <br />After confirmation from the City Attorney that a new application for use of this <br />property could not be allowed for two years if the Appeal is upheld, Council <br />Member Galvan suggested a compromise indicating that he would MOVE the <br />denial ofthe Appeal without prejudice, as it relates to the contiguous property. <br /> <br />Vice Mayor Glaze stated the applicant knew the process and chose to ignore the <br />rules. He added he is not supportive ofthe proposed motion, as stated. He further <br />indicated that to consider a new plan would still set a precedent for the railroad <br />right-of-way and would impact the City's bike path plans and possible "rails to <br />trails" conversion. <br /> <br />The following Motion was then introduced: <br /> <br />Minute Order NQ. 2001-45, Matter of Anneal bv Stenhen G.
