<br />Section I. <br /> <br />Definitions <br /> <br />1 <br />2 Unless the context otherwise requires, the terms defined in this Section shall, for <br />3 all purposes of this Agreement, have the meanings herein specified. <br />Administrative Costs During Construction <br />The term "Administrative costs During Construction" shall mean those general <br />6 administrative, legal, fiscal, and management expenses associated with the studies, <br />reports, design, engineering, inspection, construction contracts, surveys, right of way <br />8 acquisitions, and grants program for all of the Phase I Project facilities for both Joint <br />9 Use and Sole Use, and during the period commencing on February 15, 1974 through <br />10 March 31, 1981. It shall exclude costs directly identified with and directly charged to <br />Project Costs or' allocated to Planning and Special Studies or Operation and <br />Maintenance Costs. <br /> <br />4 <br /> <br />5 <br /> <br />7 <br /> <br />11 <br />12 <br /> <br />13 <br /> <br />Aqency and Agencies <br />14 The term "Agency" shall mean either Hayward, San Leandro, Oro Loma, Castro <br />15 <br />Valley, or Union. The term "Agencies" shall mean Hayward, San Leandro, Oro Loma, <br />16 <br />Castro Valley, and Union. <br />17 <br />AQreement <br />The term "Agreement" shall mean this Third Amended Joint Exercise of Powers <br />19 <br />Agreement. <br />20 <br />21 Authority <br />22 The term "Authority" shall mean the joint powers agency, known as the East Bay <br />23 Dischargers Authority, which was created by the Joint Exercise of Powers Agreement <br />24 dated February 15, 1974. <br />25 Commission <br /> <br />26 <br />27 <br />28 <br />29 <br />30 <br />31 <br />32 <br /> <br />18 <br /> <br />The term "Commission" shall mean the East Bay Dischargers Commission, being <br />the governing body of the Authority. <br />Controller <br />The term "Controller" shall mean that individual designated by the Commission to <br />assure proper expenditure and accountability of funds and responsible for audit and <br />reporting of the accounts and records of the Authority. <br /> <br />-2- <br />
