<br />BACKGROUND <br /> <br />The subject properties are located between Washington Avenue and San Leandro Boulevard and <br />are comprised of five separate parcels. The existing conditions are as follows: 2392 Cherry Street <br />is used as vehicle storage and "no address" Cherry Street is vacant; 2385 Washington Avenue is <br />developed with a single-family home; 239.3 Washington Street is developed with a warehouse <br />and wholesale distribution business; 2411 Washington Street is used as a vehicle storage <br />business and an auto repair business. <br /> <br />In August 2006, staff received an application requesting a rezone and Zoning Code amendment <br />of two properties on the comer of Cherry Street and Hudson Lane from the existing zoning of <br />RD Residential Duplex and IL Industrial Light to a commercial zoning. In the future, the <br />applicant proposes to apply for a Conditional Use Permit for an auto repair use at the two Cherry <br />Street properties (2392 and "no address" Cherry Street.) Auto repair is a conditionally permitted <br />use in the proposed CC Zoning District. Their current auto repair use is located at 2411 <br />W ashington Avenue. The applicant currently operates the business as a tenant, and they desire to <br />purchase the properties on Cherry Street to locate their business. <br /> <br />STAFF ANALYSIS <br /> <br />Staff reviewed the proposal and determined that a rezone of the subject properties to a <br />commercial zoning district, CC Commercial Community, would provide an opportunity to <br />modify the zoning on those two properties and three additional properties to bring the zoning into <br />conformance with the existing General Plan designation, Corridor Mixed Use. State law <br />governing General Plan requires that the Zoning Map be in compliance with the General Plan <br />Land Use Map. <br /> <br />The properties would be rezoned to a zoning designation that is consistent with the General Plan, <br />from RD Residential Duplex and IL Industrial Limited, to CC Commercial Community. The CC <br />Zoning District allows for a wide range of commercial and residential uses. <br /> <br />The Zoning Code Article 6 - Commercial District indicates the following specific purposes for <br />the City's commercial districts: <br /> <br />. Provide appropriately located areas consistent with the General Plan for a full range of office, <br />retail commercial, and service commercial uses needed by residents, businesses, and visitors <br />in the City and region; <br /> <br />. Strengthen the City's economic base, and provide employment opportunities close to home <br />for residents of the City and surrounding communities; <br /> <br />. Create suitable environments for various types of commercial uses, and protect them from the <br />adverse impacts of inharmonious uses; <br /> <br />.
