C. Prior to approval of the Final Map, ten (10) copies of the proposed Conditions, Covenants, and Restrictions (CC&R's) shall be submitted for the review and approval of the City Attorney, City Engineer, and the Community Development Director. The CC&R's shall specify the responsibilities of the property owners and the Property Owner's Association (POA) with respect to maintenance of easements, streets, landscaping, common areas, the wetlands area, and fencing. The CC&R's shall also specify the review authority of the POA for private improvements. D. The CC&R's shall include a prOVIsIon in which the property owners andlor tenants within the subdivision shall not park or store boats, trailers, camper tops, inoperable vehicles and the like outside the buildings, within the project. In addition, the CC&R's shall include a provision in which the property owners andlor tenants shall not obstruct the emergency vehicle access and the designated trash enclosures. E. All exterior mechanical equipment such as air conditioninglheating units and antennas shall be screened from view so as not to be visible from adjacent properties or streets to the satisfaction of the Community Development Director. This condition shall not apply to wireless cable receivers that do not exceed three (3) feet in diameter. F. All walls, fences, and landscaping within twenty-five (25) feet of any street intersection or driveway shall be maintained at a height of not more than thirty-six (36) inches above the top of the nearest adjacent curb and gutter to allow for adequate sight distance, unless otherwise approved by the City Engineer. G. A range of energy conservation measures, such as use of energy-conserving appliances and indoor and outdoor lighting, shall be incorporated into the final building plans to substantially reduce average per capita daily consumption. H. Bicycle racks shall be provided on each lot in an easily accessible location. Bicycle rack locations shall be indicated on plans submitted for building permit approval, to be reviewed and approved by the Community Development Director. 1. Prior to issuance of building permits for each new building or future changes in business licenses, the applicant shall submit a detailed proposal, to be reviewed and approved by the Community Development Director, for incorporation of 'clean air' practices recommended by the Bay Area Air Quality Management District. Recommendations may include, but are not limited to, the use of alternative-fueled vehicles (CNG, electric. etc.) for fleet trucks/cars; incorporation of 'clean air' equipment that may be associated with the future business (for roof-mounted and ground-mounted equipment); incorporation of showers/locker room facilities for employees that bike to work or who exercise during lunch; incorporation of lunch- room facilities; inclusion of designated carpool parking spaces; programs andlor Revised Reconunended Conditions of Approval PLN2002-00031 Bayside Business Park November 4, 2002 Page 12
