District hereby agrees and grants access to City staff, its designees, and assigns to enter the school site as may be necessary in order to complete design and construction performed under this agreement. IV. Ownership of Improvements and Cost Repairing and Replacing Same All improvements installed on the Site shall remain property of the District, which shall be solely responsible for the repair and replacement of damaged property. V. Maintenance Responsibilities District shall be solely responsible for maintenance of the Site and Facilities and all utility costs. VI. Project Schedule It is generally agreed that, within the constraints of the construction process, it is desirable for construction to occur between June 2007 and September 2007. Within forty-five (45) days of final approval of this agreement, the parties will work together to establish a mutually agreeable schedule for all project activities. The City will work with District to meet the agreed schedule but City provides no warranty that schedule will be met. VII. Termination of Agreement a. Notice of Termination. Either party may terminate this Agreement by mutual consent or cause with delivery of written notice of election to terminate at least six (6) months in advance.
