All employees of this business or contractors with the business involved in <br />massage of clients shall be Certified Massage Therapists (CMTs) and shall <br />obtain individual massage therapist permits in compliance with Municipal <br />Code Section 4-23-400. <br /> <br />C. <br /> <br />Any complaints regarding this business may be grounds for a review hearing <br />by the Board of Zoning Adjustments or revocation of the business license, <br />subject to a decision by the Community Development Director and the <br />Police Chief. <br /> <br />i <br /> <br />D. This use permit allows two massage therapy tables and one massage chair. <br />Any use of additional space in this building for massage therapy, whether it <br />is an expansion of this business or a new massage therapy business, shall be <br />required to go through a separate Conditional Use Permit process. <br /> <br />E. The approvals granted by the City as a result of this application, as well as <br />the Conditions of Approval, shall be recorded in the office of the County <br />Recorder of Alameda County. <br /> <br />F. No application for amendment of the application or Conditions of Approval <br />may be submitted or accepted for processing by the City unless (i) there is <br />full compliance with all terms of the application and Conditions of <br />Approval; or (ii) the Development Services Director waives compliance <br />with the terms of the application and Conditions of Approval pending <br />application for amendment. <br /> <br />G. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on July <br />6, 2007, unless a) a business license has been issued, coupled with diligent <br />progress evidencing a good faith intent to commence the intended use, or b) <br />a written request for a one-year extension of the use permit is approved by <br />the Zoning Enforcement Official. <br /> <br />Agreement to Conditions <br />PLN2006-00046 <br /> <br />July 6, 2006 <br />Page 5 of5 <br />
