<br />STAFF REPORT <br /> <br />APPROVED AND <br />FORWARDED TO <br />CITY COUNCIL <br /> <br />CITY OF SAN LEANDRO <br /> <br />DATE: <br /> <br />April 10,2007 <br /> <br />~ermarriS <br />anager <br /> <br />TO: John Jermanis, City Manager <br /> <br />FROM: Jesse Baloca, Finance Dire~ <br /> <br />SUBJECT: Amendment to San Leandro Municipal Code Chapter 4-23 <br />Regarding Massage Establishments and Massage Services (Massage Ordinance) <br /> <br />RECOMMENDATION <br /> <br />Staff recommends that the City Council approve amendments to the City's Massage Ordinance <br />to include the addition of Acupuncture and Acupressure type of services. Acupuncture and <br />Acupressure establishments and their employee's conducting these services will be subject to the <br />same permit review and approval process as a typical massage establishment, prior to their <br />conduct of business. <br /> <br />. <br /> <br />BACKGROUND AND DISCUSSION <br /> <br />In addition to a business license, the City currently requires a typical massage establishment to <br />undergo a permit review and approval process. The permit is required for each massage <br />establishment as well as for each masseur or masseuse. A masseur or masseuse is defined as any <br />person engaged in the practice of massage, for (monetary) consideration. <br /> <br />Currently, a massage establishment is defmed as a fixed place of business where massage occurs <br />and includes massage and bath house as an example of an establishment. The inclusion of <br />acupuncture and acupressure businesses into the existing Massage Ordinance is intended to <br />address and allow more scrutiny over those establishments that may also be in the business of <br />prostitution. <br /> <br />According to the City's Police Department, businesses that engage in prostitution will often <br />ignore the City's Massage Ordinance by changing the business name/type to a healing center <br />offering acupuncture or acupressure along with other non-massage type services (e.g. <br />prostitution). This tactic is done in an attempt to circumvent the current business license process <br />and permitting requirement for typical massage business types. <br /> <br />ThePermittine: Process <br />"Every person acting in the capacity of acupuncturist, masseur or masseuse shall all times when <br />so engaged, wear... an identification nameplate containing his or her photograph, name and <br />permit number."
