<br />DRAFT 4/02/07 <br /> <br />any advertising matter that depicts any portion of the human body that would reasonably <br />suggest to prospective patrons that any service is available other than those services <br />described in Section 4.23-100, nor shall any acupuncture or massage establishment indicate <br />in the text of such advertising that any service is available other than those services <br />described in Section 4-23-100. <br /> <br />Section 19. Section 4-23-525 of Title 4 of the San Leandro Municipal Code is hereby <br />amended to read as follows: <br /> <br />"No acupuncture or massage may be carried on within any cubicle, room, booth or <br />any area within an acupuncture or massage establishment, which is fitted with a door <br />capable of being locked." <br /> <br />Section 20. Section 4-23-530 of Title 4 ofthe San Leandro Municipal Code is hereby <br />amended as follows: <br /> <br />a. The title of Section 4-23-530 is amended to read as follows: "4-23-530 <br />UNLICENSED ACUPUNCTURIST, MASSEUR OR MASSEUSE." <br /> <br />b. Section 4-23-530 is amended to read as follows: "No permittee shall employ <br />as an acupuncturist, masseur or masseuse any person who does not possess a valid <br />unrevoked and unexpired permit issued pursuant to the provisions of Article 4 of this <br />Chapter." <br /> <br />Section 21. Effective Date and Publication. <br /> <br />This ordinance shall take effect thirty (30) days after adoption and the title thereof shall be <br />published once prior to adoption. <br /> <br />Section 22. Severability. <br /> <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the <br />ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of <br />competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining. <br />portions of this Ordinance or any part hereof.
