One of the greatest attractions of the Marina, in addition to its proximity to the Oakland Airport, <br />is its tranquil, isolated atmosphere away from the hustle and bustle of the airport and the freeway. <br />Whereas many airport-serving businesses present guests with a busy thoroughfare or highway, <br />loud noise, and an unattractive urban environment, the Marina offers a quiet, pleasant, waterfront <br />area with amenities including a shoreline park, jogging trails, and renovated golf facilities. The <br />combination of this character located within a short drive of the airport is a tremendous asset. <br /> <br />. The future success of the Marina businesses would depend to a large degree on maintaining a <br />viable boat marina. The continued operation (and thus, dredging) of the Marina is essential to the <br />success of the area. <br /> <br />REGULATORY CONSIDERA nONS <br /> <br />Sedway Group interviewed representatives of the San Leandro Planning Department to understand <br />the regulatory constraints on land use at the Marina. A variety of agencies have jurisdiction over part <br />or all of the Marina area, including the City of San Leandro, the San Francisco Bay Conservation and <br />Development Commission (BCDC), the Regional Water Quality Control Board, and the Army Corps <br />of Engineers. In general, Sedway Group relied upon information provided by the City of San Leandro <br />regarding regulatory issues. <br /> <br />City of San Leandro <br /> <br />The Marina area is designated as a "no change" area in the City's General Plan, which recognizes the <br />existing restaurant, hotel, marina and recreational uses. The area is zoned CR, Commercial <br />Recreation, which promotes the continuation and expansion of the existing uses. Uses permitted in the <br />CR district include commercial recreation, eating and drinking establishments, marine sales and <br />service, park and recreation facilities, and retail sales (including health and fitness centers and <br />theaters). Conditional uses include marinas, hotels, motels and bed and breakfasts, c1ubsand lodges, <br />eating and drinking establishments with entertainment or take-out, outdoor theaters, sports arenas, and <br />farmers. markets. 2 <br /> <br />The possibility exists for both a general plan amendment and a zoning change to allow other uses. <br />However, zoning changes to allow other uses at the Marina, such as office or residential, could be <br />fairly controversial. A potential issue related to development at the Marina is the sensitivity of the <br />nearby residential neighborhood to traffic on Marina Boulevard. This neighborhood is very vocal and <br />is likely to oppose uses that generate additional real or perceived traffic on the thoroughfare. <br /> <br />Bay Conservation and Development Commission and Other Agencies <br /> <br />The BCDC has jurisdiction of land located within 100 feet of the San Francisco Bay shoreline. This <br />area includes most of the Marina, with the potential exception of some areas located east of Neptune <br />Drive. Under the BCDC Bay Plan, Commercial Recreation uses are allowed at the Marina. The top <br />tier of uses includes hotel, restaurant and retail. Office is not a preferred use and residential is not <br /> <br />2 Interestingly. although office and residential uses are not permitted, the stated purpose of the CR district is to <br />"provide sites for recreation-oriented uses and residential and commercial activities, such as hotels, restaurants <br />and office uses that are compatIble with water-front recreation and open space uses, conveniently located near <br />the marina." <br />
