<br />311 MacArthur Boulevard; PLN2006-00 1 04 <br /> <br />2 <br /> <br />May 7, 2007 <br /> <br />Recommendation: <br /> <br />The Planning Commission and staff recommend that the City Council approve the following: <br /> <br />A. Rezone the property from CC Commercial Community District to CC(PD) Commercial <br />Community, Planned Development Overlay District and from RS Residential Single- <br />Family to RS (PD) Residential Single-Family Planned Development Overlay District. <br /> <br />B. Approve the Planned Development to create a 23-unit townhome development, subject to <br />the recommended conditions of approval. <br /> <br />C. Approve Vesting Tentative Map, Tract 7875 to allow the existing five lots to be merged <br />into a larger lot totaling approximately 43,525 square feet and to create a condominium <br />lot with 23 individual ownership units and common space (driveway, open space area and <br />landscaping), subject to the recommended conditions of approval. <br /> <br />BACKGROUND <br /> <br />. The subject site comprises five separate parcels that together encompass 42,437 square feet <br />(0.97 acre). The proposal includes the incorporation of 1,088 square feet of City right-of-way <br />(to be vacated) which would increase the overall size of the site to 43,525 square feet (0.99 <br />acre) . <br /> <br />. The MacArthur Boulevard-fronting portion of the property (0.84 acres) is zoned CC <br />Commercial Community Zoning District and a smaller Herma Court-fronting portion of the <br />property (0.16 acres) is zoned RS Residential Single-Family Zoning District. <br /> <br />. The site is located on the west side of MacArthur Boulevard at the north comer of Herma <br />Court. The northern comer of the triangular property is located at the intersection of <br />Broadmoor Boulevard and MacArthur Boulevard. The eastern and western edges of the <br />subject property border single-family residences that are located on MacArthur Boulevard <br />and Herma Court, respectively. Commercial sites on MacArthur Boulevard are developed <br />with small-scale commercial uses, including a barber shop, a hair salon and a Chinese <br />restaurant. The property is located in the Broadmoor neighborhood. It is one block south of <br />the Oakland city limit. <br /> <br />. In July 2006, the Planning Commission conducted a work session to review a proposal to <br />redevelop the subject property with a mixed-use residential project, with 14 townhome units, <br />2 single-family homes and 3,223 square feet of commercial space. The Commission provided <br />comments on the site layout and expressed concern over the viability of the commercial space <br />and the lack of parking for the commercial use as well as opposition to the use of the narrow <br />Herma Court lot for a narrow single-family home. <br /> <br />. The applicant came in with a new proposal in December 2006 which eliminated the <br />commercial use in the comer space and increased the number of residential units from 16 to <br />
