<br />The proposal is consistent with City goals, objectives and policies related to housing and land <br />uses outlined in the General Plan. The project increases the housing supply in a manner that will <br />be compatible with the existing area. The development will result in an improvement in <br />appearance to the property, which is currently underutilized. In addition to aesthetic quality, the <br />new row homes will be designed, constructed and equipped to provide an adequate level of safety <br />and security for the residents. Furthermore, the site will be adequately served with public <br />services, including utilities. <br /> <br />Vesting Tentative Map <br /> <br />Two versions of a vesting tentative map (Tract 7875) are included with this proposal. The map <br />shows the proposed property line boundaries, the common area, and infrastructure serving the <br />proposed development. The map conforms to the proposed Planned Development previously <br />described. <br /> <br />The Planning Commission is being asked to review and forward a recommendation of either the <br />"proposed" or the "alternate" tentative map. Staff believes that the two versions of the map are <br />substantially similar and that, with the recommended conditions of approval to address issues <br />regarding the location of the open space, either proposal could proceed to City Council for a final <br />map approval. <br /> <br />A standard recommended condition of approval would require the developer to draft, for the <br />City's and City Attorney's review, Conditions, Covenants and Restrictions (CC&Rs) prior to <br />approval of the Final Map. The CC&Rs will contain language specifying the future property <br />owners' responsibilities as a homeowner's association in maintaining the paved driveway and <br />guest parking areas, maintenance of common areas and limiting certain uses such as BBQs <br />therein, required use of garages for resident parking, and the landscaping in the front and side of <br />the homes on MacArthur Boulevard and Herma Court. In addition, the CC&Rs should include <br />the property owners' individual responsibilities in maintaining their respective patios free of <br />clutter and prohibit outdoor storage. <br /> <br />School District <br /> <br />The Tentative Map for the project, with a description of the project basic details, has been sent to <br />the San Leandro Unified School District for their review and comment on two occasions: August <br />2006 and March 2007. Staff also made follow up email and phone contact to solicit an official <br />comment on this project. As of the writing of this report, staff has not received a statement <br />whether this project will have a significant impact on the school facilities that would serve this <br />development. Staff notes that the standard conditions of approval for payment of school impact <br />fees is included. <br /> <br />ENVIRONMENTAL ANALYSIS <br /> <br />This project to construct 23 single-family townhomes on an approximate one-acre site is <br />categorically exempt from the California Environmental Quality Act (CEQA) per CEQA Guideline <br /> <br />Planning Commission Staff Report <br />PLN2006-00 1 04 <br /> <br />April 12, 2007 <br />Page 14 of 16 <br />
