<br />Article 19, Categorical Exemption, Section 15332 as Infill Development. Furthennore, the rezoning <br />is exempt from CEQA, per CEQA Guideline, Section 15061 (b) (3), where it can be seen with <br />certainty that there is no possibility that the rezoning in question may have a significant effect on <br />the environment. <br /> <br />PUBLIC OUTREACH <br /> <br />The developer presented the project to the Broadmoor Neighborhood Association on June 14, <br />2006 and again on November 8, 2006. An additional meeting was arranged by the developer for <br />the immediate neighbors at Stepping Stones on March 29, 2007. At those meetings, the primary <br />concerns revolved around the impact of the project's open space and the cars leaving the site on <br />the Henna Court neighborhood. In addition, general questions were brought up regarding the <br />potential increase in traffic and parking from the number of residential units. The consensus at <br />the meetings was that the project was attractive architecturally. <br /> <br />The project was presented before the West San Leandro Redevelopment Advisory Committee on <br />May 18, 2006. The committee voted to unanimously endorse the project, while registering some <br />concern about the parking on the site for a commercial use. Finally, the City Council Business <br />Development Subcommittee also reviewed the project on June 8, 2006, and expressed favorable <br />views on the proposed development. On July 27, 2006, the proposal was reviewed by the <br />Planning Commission at a worksession where the Commission provided comments to the <br />applicant and staff. <br /> <br />A legal notice was published in the Daily Review on Monday, April 2, 2007, and a mailing <br />notice for the April 12, 2007 public hearing was sent to property owners and businesses within a <br />300-foot radius of the site and to the Broadmoor Neighborhood Association. Notices were also <br />posted on telephone poles at five locations on Henna Court and MacArthur Boulevard. <br /> <br />At the time of writing this report, staff has not received individual written or telephone comments <br />apart from the verbal comments expressed by attendees of the Broadmoor Neighborhood <br />Association and the Henna Court neighborhood meetings described above. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends that the Planning Commission forward the rezone, the planned development, <br />and the vesting tentative map for PLN2006-00104 to develop a new 23-unit residential <br />subdivision to the City Council with a recommendation for approval subject to the attached <br />recommended conditions and findings. <br /> <br />As stated above, the Planning Commission is being asked to review and forward a <br />recommendation of either the "proposed" or the "alternate" tentative map. Staff believes that the <br />two versions of the map are substantially similar and that, with the recommended conditions of <br />approval to address issues regarding the location of the open space, either proposal could proceed <br />to City Council for a final map approval. <br /> <br />Planning Conunission Staff Report <br />PLN2006-00 1 04 <br /> <br />April12,2007 <br />Page 15 of 16 <br />
