Chen Construction, <br />Inc.'s Bid Contract Price Schedule for the San Leandro Residential Airport Noise Insulation <br />Program Phase I ("Phase I Program"). This letter is to confirm that the Port and the City of <br />San Leandro have undertaken to Mmeet and confer" to determine the final budget for the <br />Phase I Program as provided for in Section 2(i) of the 2000 Settlement Agreement between <br />the Port and City (the "Settlemenr). <br /> <br />The proposed final budget is within the acceptable range of the preliminary budget that the <br />Port reviewed and concurred with prior to the contractor's submission of the contract price <br />schedule for the Phase I Program. The Port agrees to provide funding for the Phase I <br />Program within the scope of insulation measures provided for in Section 2(f) of the <br />Settlement, as amended by the 2002 Addendum to the Settlement.
