<br />B. All necessary Building Permits shall be obtained. The building permit application <br />shall include but is not limited to convert the garage used for automobile detailing <br />into a B Occupancy (place of business); the exterior walls adjacent to the property <br />lines shall be adequately fire-rated; the garage shall have adequate exiting; and the <br />garage and the sales office shall be equipped with fire extinguishers. The sales <br />office shall be required to be addressed. The wrought-iron gate shall be equipped <br />with a Fire Department key box for Fire Department access. <br /> <br />VI. REDEVELOPMENT AGENCY-OWNER PARTICIPATION AGREEMENT <br />(Added May 15, 2006) <br /> <br />A. Prior to issuance of Certificate of Occupancy, Applicant and/or Owner shall <br />negotiate and enter into an Owner Participation Agreement (OP A) with the <br />Redevelopment Agency (Agency) for the development of Site and any adjacent <br />property(ies) that may be acquired, consistent with the East 14th Street South <br />Area Development Strategy (adopted April 2004) and the SA-3 District zoning <br />requirements. The OP A shall provide for the negotiation and execution of a <br />master plan for the development of the Site and adjacent property(ies) and shall <br />provide that the Applicant/Owner agrees to undertake diligent efforts to negotiate <br />the acquisition of adjacent property(ies) and to develop the adjacent property(ies) <br />along with Site, or work with an Agency approved developer to develop adjacent <br />property(ies) and Site in accordance with these Conditions of Approval, the terms <br />of the OP A and the master plan. <br /> <br />B. Occupancy Approval- Occupancy of the Site and/or any acquired adjacent <br />property(ies) by a party, other than the Applicant and/or Owner shall be subject to <br />the Agency's review and approval prior to actual occupancy of the premises. The <br />Agency shall promptly review all applications for occupancy approval and shall <br />not unreasonably withhold approval of such applications, provided they are in full <br />accordance with the provisions of these Conditions of Approval, the OP A and the <br />master plan. The Agency may terminate an occupancy or occupancies of Site <br />and/or adjacent property(ies) upon its determination of material non-compliance <br />with any provisions of these Conditions of Approval, OP A or the master plan. <br />Continued occupancy of the Site and/or adjacent property(ies) following <br />expiration or termination of occupancy approval shall be a violation of these <br />Conditions of Approval, OP A and the master plan. <br /> <br />VII. FENCING AND SCREENING <br /> <br />A. All perimeter fencing and walls shall be structurally sound and well-maintained at all <br />times. Any damage to the fences or walls shall be promptly replaced or repaired. In <br />addition the metal wall along the westerly rear property line shall be kept in good <br />repair, clean appearance and painted a uniform neutral color at all times. <br />
