<br />(b) In Leases: <br /> <br />"The lessee herein covenants by and for the lessee and lessee's heirs, personal <br />representatives and assigns, and all persons claiming under the lessee or through <br />the lessee, that this lease is made subject to the condition that there shall be no <br />discrimination against or segregation of any person or of a group of persons on <br />account of race, color, creed, religion, sex, sexual orientation, marital status, <br />national origin, ancestry or disability in the leasing, subleasing, transferring, use, <br />occupancy, tenure or enjoyment of the property herein leased nor shall the lessee <br />or any person claiming under or through the lessee establish or permit any such <br />practice or practices of discrimination of segregation with reference to the <br />selection, location, number, use or occupancy oftenants, lessees, sublessees, <br />subtenants, or vendees in the property herein leased." <br /> <br />( c ) In Contracts <br /> <br />"There shall be no discrimination against or segregation of any person or group of <br />persons on account of race, color, creed, religion, sex, sexual orientation, marital <br />status, national origin, ancestry or disability in the sale, lease, sublease, transfer, <br />use, occupancy, tenure or enjoyment ofthe property nor shall the transferee or <br />any person claiming under or through the transferee establish or permit any such <br />practice or practices of discrimination or segregation with reference to selection, <br />location, number, use or occupancy of tenants, lessee, subtenants, sublessees or <br />vendees of the land." <br /> <br />6.7 Binding on Successors; No Subordination. The restrictions set forth in this <br />Article VI shall be binding upon Tenant and its successors and assigns for the full Term of this <br />Lease, and shall not be subordinated to any interest, lien, or mortgage; provided however, the <br />affordability restrictions specified in Section 6.3 shall be effective for a term of fifty-five (55) <br />years commencing upon the issuance of a final certificate of occupancy for the Project unless <br />extended pursuant to Section 3.1. If Developer is unable to otherwise obtain construction <br />financing on reasonable terms, Agency shall permit the affordability restrictions to be <br />subordinated to the construction fmancing for the Project provided that the requirements set forth <br />in California Health and Safety Code Section 33334.14 (a)(4) are satisfied. <br /> <br />6.8 Management and Operation of the Proiect; Compliance with Laws. Tenant agrees <br />to use its best efforts to operate, maintain and manage the Property in first-class manner, subject <br />to incidental wear and tear. Tenant, at its sole cost and expense, shall comply with all Applicable <br />Laws pertaining to the use, operation, occupancy and management of the Property. Tenant shall <br />not itself, and shall not permit any subtenant to use the Property or the Improvements for any <br />unlawful purpose and shall not itself, and shall not permit any subtenant to, perform, permit or <br />suffer any act of omission or commission upon or about the Property or the Improvements which <br />would result in a nuisance or a violation of Applicable Law. Landlord shall have the right to <br />review and approve the qualifications of any management entity proposed by Tenant for the <br />Project. Landlord hereby approves Nebraska Mercy Services Corporation, a Nebraska not-for- <br />profit entity as the initial management entity for the Project.
