GoiJi....''-' '- / 68AStG.- <br />""D~T ORb, NANGr=:. <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />ORDINANCE NO. 2006- <br /> <br />AN ORDINANCE AMENDING TITLE 1 OF THE SAN LEANDRO MUNICIPAL CODE BY <br />ADDING CHAPTER 15 (RELATING TO LIVING WAGE STANDARDS FOR CITY- <br />ASSISTED BUSINESSES) AND AMENDING SECTIONS 1-5-225 AND 1-6-220 <br />(RELATING TO CONTRACTOR COMPLIANCE WITH LEGAL REQUIREMENTS) <br /> <br />WHEREAS, the City wishes to ensure that it contracts only with businesses which comply with <br />applicable laws; <br /> <br />AND WHEREAS, the City wishes to ensure that it contracts only with businesses which provide <br />jobs paying living wages and preferably medical benefits, thus helping reduce poverty and avoid <br />workers becoming a burden upon society; <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: <br /> <br />Section 1. Living Wage at Publicly-Assisted Businesses. <br /> <br />Title 1 of the Municipal Code of the City of San Leandro is hereby amended to add the <br />following Chapter 15 to read as follows: <br /> <br />CHAPTER 15. LIVING WAGE AT PUBLICLY-ASSISTED BUSINESSES <br /> <br />ARTICLE 1. <br /> <br />SCOPE AND DEFINITIONS <br /> <br />1-15-100: "Publicly-Assisted Business" or "P AB" means (1) any person receiving in excess of <br />$100,000 worth of financial assistance from the City over a 12-month period, or (2) any City <br />Contractor as defined herein. <br /> <br />1-15-105: "City Contractor" here means any person which is party to a City Contract, which <br />shall be defined here as follows: <br />(1) Any service contract with the City for work to be performed for the City under which <br />the City is expected to pay more than $25,000 per year, or if the contractor is a non-profit <br />organization, over $100,000 per year. <br />(2) Any lease, license or concession from the City to a business with gross revenues <br />exceeding $350,000 annually involving payments to the City expected to exceed $50,000 either <br />(a) over the term of the contract, lease or license, or (b) during the next 5 years if the current term <br />is less than 1 year but which may be extended; <br />(3) any subcontract, sublease, sublicense, management agreement or other transfer or <br />assignment of any right, title or interest received from the City pursuant to any of the foregoing <br />contracts, leases, licenses or concessions. <br />A contract with the City shall not be deemed a City Contract unless entered into after <br />enactment of this Chapter, or amended after enactment of this Chapter to benefit in any way the <br /> <br />1 <br />
