IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 2006- AN ORDINANCE AMENDING TITLE 1 OF THE SAN LEANDRO MUNICIPAL CODE BY ADDING CHAPTER 15 (RELATING TO LIVING WAGE STANDARDS FOR CITY- ASSISTED BUSINESSES) AND AMENDING SECTIONS 1-5-225 AND 1-6-220 (RELATING TO CONTRACTOR COMPLIANCE WITH LEGAL REQUIREMENTS) WHEREAS, the City wishes to ensure that it contracts only with businesses which comply with applicable laws; AND WHEREAS, the City wishes to ensure that it contracts only with businesses which provide jobs paying living wages and preferably medical benefits, thus helping reduce poverty and avoid workers becoming a burden upon society; NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as follows: Section 1. Living Wage at Publicly-Assisted Businesses. Title 1 of the Municipal Code of the City of San Leandro is hereby amended to add the following Chapter 15 to read as follows: CHAPTER 15. LIVING WAGE AT PUBLICLY-ASSISTED BUSINESSES ARTICLE 1. SCOPE AND DEFINITIONS 1-15-100: "Publicly-Assisted Business" or "P AB" means (1) any person receiving in excess of $100,000 worth of financial assistance from the City over a 12-month period, or (2) any City Contractor as defined herein. 1-15-105: "City Contractor" here means any person which is party to a City Contract, which shall be defined here as follows: (1) Any service contract with the City for work to be performed for the City under which the City is expected to pay more than $25,000 per year, or if the contractor is a non-profit organization, over $100,000 per year. (2) Any lease, license or concession from the City to a business with gross revenues exceeding $350,000 annually involving payments to the City expected to exceed $50,000 either (a) over the term of the contract, lease or license, or (b) during the next 5 years if the current term is less than 1 year but which may be extended; (3) any subcontract, sublease, sublicense, management agreement or other transfer or assignment of any right, title or interest received from the City pursuant to any of the foregoing contracts, leases, licenses or concessions. A contract with the City shall not be deemed a City Contract unless entered into after enactment of this Chapter, or amended after enactment of this Chapter to benefit in any way the 1
