<br />Draft Living Wage Ordinance <br /> <br />2 <br /> <br />May 30, 2007 <br /> <br />Applicability: City regular and permanent part-time employees, City servIce <br />contractors, businesses and non-profits receiving financial assistance and lessees, <br />concessionaires and franchisees. <br /> <br />Waivers: By City Council for financial hardships, emergencies and circumstances in <br />the public interest. <br /> <br />Current contracts: Amendments affecting financial aid require compliance. <br /> <br />Exemptions: Include other governmental agencies, job training, disabled, internships, <br />minors, immediate family, prevailing wage contracts and bona-fide collective <br />bargaining agreements. <br /> <br />Retaliation: Prohibited <br /> <br />Complaints to City: City Manager establishes investigative procedures. <br /> <br />Enforcement: Private party action; no City liability. City may terminate violators' <br />agreements. <br /> <br />Effective date: September 1,2007 <br /> <br />In developing the draft ordinance, the Finance Committee and staff considered the following <br />elements. <br /> <br />Consistent with most surrounding City ordinances. <br /> <br />Wages higher than, or equal to, Oakland, Hayward and Emeryville. <br /> <br />Days off consistent with other ordinances. <br /> <br />Applicability/waiver/exemption similar to other ordinances. <br /> <br />Enforcement consistent with other ordinances. City investigation and private action. <br /> <br />Minimize affect on non-profits, public, private and redevelopment partnerships. <br /> <br />Applicability to the City's regular and permanent part-time employees. <br /> <br />Minimize City staff resources and costs for implementation and enforcement. <br /> <br />Attached are two matrixes provided the Finance Committee. The first matrix is "Comparative <br />Matrix of Living Wage Rates and Attributes - Six Bay Area Cities". The second matrix consists <br />of "Living Wage Information on Community-Based Organizations - Marina Lessees and Other <br />Service Providers (Contracts)." <br />
