<br />1-15-605 <br /> <br />Waiver <br /> <br />Any waiver by an individual of any of the provisions of this Chapter shall be deemed <br />contrary to public policy and shall be void and unenforceable, except that Employees shall not be <br />barred from entering into a written valid collective bargaining agreement waiving a provision of <br />this Chapter if such waiver is set forth in clear and unambiguous terms and the total <br />compensation package of the bargaining unit as a whole exceeds the minimums set forth herein. <br />Any request to an Employee by a P AB to waive his or her rights under this Chapter shall <br />constitute a violation of this Chapter. <br /> <br />ARTICLE 7. ENFORCEMENT <br /> <br />1-15-700. Payroll Records <br /> <br />Each P AB shall maintain for each person in City.related employment a record of his or <br />her name, pay rate and, if the P AB claims credit for health benefits, sums paid by the P AB for <br />the employee's health benefits. The P AB shall submit to the City a copy of such records for the <br />prior calendar year by March 31 st of the succeeding year. Failure to provide a copy of such <br />records within five days of the due date will result in a penalty of five hundred dollars ($500.00) <br />per day. Each P AB shall maintain a record of the name, address, job classification, hours <br />worked, and pay and health benefits received of each person employed, and shall preserve them <br />for at least three years, and make those available to the City upon reasonable request. To the <br />fullest extent permitted by law the City shall preserve the confidentiality of any personal <br />identifying information on the records it is provided. <br /> <br />1-15-705 <br /> <br />Notice to Employees <br /> <br />Each P AB shall give written notification to each current Employee, and to each new <br />Employee at time of hire, of his or her rights under this Chapter. The notification shall be in the <br />form provided by the City in English, Spanish and other languages spoken by a significant <br />number of the employees, and shall also be posted prominently in areas at the work site where it <br />will be seen by all Employees. <br /> <br />1-15-710 <br /> <br />Access to Facilities for Enforcement Purposes <br /> <br />Each P AB shall permit reasonable access to work sites and relevant payroll records to <br />authorized City representatives for the purpose of monitoring compliance with this Chapter and <br />investigating employee complaints of noncompliance. Each P AB shall permit representatives of <br />organizations assisting employees in its industry to have reasonable access to its workforce <br />during non-working time and in non-work areas for the sole purpose of ensuring compliance <br />with this Chapter. <br /> <br />1-15-715 <br /> <br />City Staff Duties <br /> <br />5 <br />
