<br />1-15-405 <br /> <br />Reasonable Amounts of Leave <br /> <br />Employees of P AB' s shall be entitled to at least 22 days off per year for sick leave, <br />vacation, or personal necessity. At least twelve (12) of the required days off shall be <br />compensated at the same rate as regular compensation for a normal working day. Ten (10) of the <br />required 22 days may be uncompensated days off. Employees who work part-time shall be <br />entitled to accrue compensated days off in increments proportional to that accrued by full-time <br />employees. Employees shall be eligible to use accrued days off after the fIrst six (6) months of <br />satisfactory employment or consistent with employer policy, whichever is sooner. Paid holidays <br />may be counted toward provision of the required twelve (12) compensated days off. Employees <br />of P AB' s shall also be entitled to paid leave for any required jury duty. <br /> <br />1-15-410 <br /> <br />Additional Compensation Permissible <br /> <br />Nothing in this Chapter shall be construed to limit an employer's discretion to provide <br />greater wages or leave to its employees. <br /> <br />ARTICLE 5. PREVENTING DISPLACEMENT OF WORKERS <br /> <br />1-15-500 Worker Retention for 90 Days <br /> <br />Each P AB which is to replace a prior P AB shall offer employment to the Employees of <br />the prior P AB. Such Employees may be not be terminated by the new P AB during the fIrst 90 <br />work days except for just cause. The new P AB may operate at lower staffing levels than its <br />predecessor but in such event, shall place its predecessor's Employees on a preferential <br />reinstatement list based on seniority. For purposes of this Section, a P AB "replaces" another if it <br />(1) assumes all or part of the lease, contract, subcontract or City aid of a prior employer or <br />obtains a new lease, contract, or sublease, and (2) offers employment which Employees of the <br />prior P AB can perform. <br /> <br />1-15-505 <br /> <br />Retention of Managerial Status Not Required <br /> <br />Nothing herein shall be construed to require that supervisory, managerial or confIdential <br />Employees retained by the new P AB be kept in a supervisory, managerial or confidential <br />position. <br /> <br />ARTICLE 6. RET ALIA TION AND DISCRIMINATION BARRED; WAIVERS <br /> <br />1-15-600 Non-retaliation <br /> <br />No person may discharge, reduce the compensation of or otherwise discriminate against <br />any person for making a complaint to the City, participating in any of its proceedings, using any <br />civil remedies to enforce his or her rights, or otherwise asserting his or her rights under this <br />Chapter. For the fIrst nine months after an employee engages in such activities, the employer <br />may not without just cause discharge, suspend, or otherwise reduce the pay of such employee. <br /> <br />4 <br />
