<br />IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2007-008 RDA <br /> <br />(2926) <br /> <br />RESOLUTION MAKING HEALTH AND SAFETY CODE SECTION 33445 FINDINGS AND <br />AUTHORIZING THE USE OF REDEVELOPMENT AGENCY FUNDS FOR THE SENIOR <br />CENTER PHASE 1 IMPROVEMENTS, PROJECT NO. 06-210-18-116 <br /> <br />Recitals <br /> <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33421 <br />authorizes a redevelopment agency to cause the installation of public improvements necessary in <br />the project area for carrying out the redevelopment plan; and <br /> <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the cost of the construction of any building, facility, structure, or other improvements <br />that is publicly owned either within or without the project area if it detelmines all of the <br />following: <br /> <br />1. The buildings, facilities, structures, or other improvements are of benefit to the project <br />area or the immediate neighborhood in which the project is located; and <br /> <br />2. That no other reasonable means of financing the buildings, facilities, structures, or other <br />improvements are available to the community; and <br /> <br />3. That the payment of funds for the cost of buildings, facilities, structures, or other <br />improvements will assist in the elimination of one or more blighting conditions inside the <br />proj ect area; and <br /> <br />4. The project is consistent with the Five Year Implementation Plan adopted by the <br />Redevelopment Agency (Agency) pursuant to Section 33490; and <br /> <br />WHEREAS, the Agency of the City of San Leandro is engaged in the Senior Center <br />Phase 1 Improvements, Project No. 06-210-18-116, improvement project within the Alameda <br />County/City of San Leandro Redevelopment Project Area (Project Area), which is designed in <br />part to upgrade the appearance of the Project Area; and <br /> <br />WHEREAS, on December 6, 2004, the Agency approved Resolution No. 2004-23 <br />adopting the 2004-2009 Implementation Plan for the Project Area, which identifies the Senior <br />Center Phase 1 Improvements, Project No. 06-210-18-116 and similar public improvements as <br />being of the highest priority in implementing the objectives of the Agency to eliminate or reduce <br />blight and blighted conditions presently existing in the Project Area; and <br /> <br />WHEREAS, tax increment funds are available from the Alameda County/City of San <br />Leandro Redevelopment Project Area to assist in financing, in part, the Senior Center Phase 1 <br />Improvements, Project No. 06-210-18-116 project as necessary; and <br />
