Then, from the time the permit is issued, she would like to see the project <br />substantially completed within six months. In the trade, she described "substantially <br />completed" except for finishing, trim-outs, and so forth. <br /> <br />Secretary Livermore recapped her understanding: If City Council approval is <br />forthcoming, construction would commence within six months and be complete within <br />six more months. <br /> <br />Assistant City Attorney Stephanie Stuart observed that the proposal needs a trigger for <br />Mr. Landes applying for a building permit. She suggested that the motion might be <br />couched in terms of the timeframe in which the applicant needs to 1) pursue a building <br />permit, and 2) commence construction - for example, within six months of issuance of <br />the permit. <br /> <br />Commissioner Ponder said that his motion was intended to include whatever was part of <br />the original one-year approval in a new six-month framework. He offered to retract his <br />motion in favor of Commissioner Collier's recommendation. <br /> <br />Acting ChairNice Chair Dlugosh said it was not necessary to retract his motion; <br />Commissioner Collier's addendum could be used as a "friendly amendment." <br /> <br />Motion to Forward PLN2007-00027 <br />to the City Council with a Recommendation for Approval <br />with the Condition that the Approval Expire <br />within Six Months instead of One Year <br />Ponder / Nardine <br /> <br />Secretary Livermore, to ensure that the applicant has clear direction, asked if the <br />Commission proposes imposing a deadline on application for building permit as well as <br />commence construction after receiving a permit. <br /> <br />Commissioner Collier reiterated that she prefers issuance of the building permit as the <br />trigger, because this is a busy time for the City and it typically takes longer to issue <br />permits during the summer. She said that the applicant should not suffer if the City takes <br />eight weeks to issue the permit. She wants the applicant to do everything possible to <br />clean up the site before receiving the permit, and then substantially complete the project <br />within six months. <br /> <br />Acting ChairNice Chair Dlugosh asked what should be done about the applicant's due <br />diligence in applying for the permit in a timely manner. <br /> <br />Commissioner Collier said she would like to see the application for the building permit <br />filed with the City within 30 days of City Council approval. <br /> <br />Commissioner Nardine wanted confirmation that property cleanup would continue <br />immediately. <br />
