<br />Living Wage Ordinance <br /> <br />-Page 3 of 4 - <br /> <br />Julv 10, 2007 <br /> <br />Current contracts are not affected; however, amendments affecting financial aid or <br />extending the contract term require compliance. <br /> <br />New contracts: Living wage provisions will be included along with a requirement for <br />written notification to employees. <br /> <br />Exemptions: Include other governmental agencies, job training, disabled, internships, <br />minors, prevailing wage contracts and bona-fide collective bargaining agreements. <br /> <br />RetaliationlWorker Retention: Retaliation is prohibited; 90 day worker retention <br />provIsIOn. <br /> <br />Compliance: City Manager establishes investigative procedures. <br /> <br />Enforcement: Private party actions; no City liability. City may terminate violator's <br />agreement and/or under municipal code impose fines totaling up to $5,000. <br /> <br />Administrative Guidelines, Regulations and Procedures: City Manager to develop. <br /> <br />Effective Date: September 1, 2007. <br /> <br />The proposed Living Wage Ordinance incorporates many of EBASE and the Central Labor <br />Council's suggestions, while maintaining the City's desire to be consistent with surrounding <br />municipalities, minimizing the effect on non-profits public, private and redevelopment <br />partnerships and minimizing City staff resources and costs for implementation and enforcement. <br />The City Attorney has reviewed the Ordinance and finds that it is enforceable. Both the <br />Alameda County Central Labor Council and EBASE have indicated their support for the <br />proposed ordinance. <br /> <br />Current City Council Policy <br />Not Applicable <br /> <br />Previous City Council Actions <br />City Council referred the living wage matter to Finance Committee at October 2, 2006 meeting. <br /> <br />Council reviewed Draft Living Wage Ordinance at the June 4,2007 meeting and referred back to <br />staff for revisions based on meetings with interests groups. <br /> <br />City Council Committee Review and Action <br />The City Council Finance Committee reviewed the Living Wage Draft Ordinances at their <br />meetings of November 1, 2006, February 7,2007, March 20,2007, and May 1, 2007. <br /> <br />Applicable General Plan Policy <br />Not Applicable <br /> <br />Permits and/or Variances Granted <br />Not Applicable <br />
