<br />maximum height of seven-feet. Fencing constructed in the front yard setbacks shall <br />not exceed three feet in height and shall be located outside of the City right-of-way. <br />Detailed plans shall be submitted for the review and approval of the Development <br />Services Director. The plans and details shall show location, final height, decorative <br />features such as lattice and posts with caps, and construction details showing grade of <br />materials and paint or stains to be used for its final finish. All fencing shall be <br />installed to the satisfaction of the Community Development Director prior to final <br />inspection. <br /> <br />B. Any electrical or gas meters, utility switch boxes, telephone, interface cabinets, outdoor <br />refuse, storage areas or other utility feature shall be screened from view by a fence, wall <br />or landscaping; details subject to the approval of the Community Development Director. <br /> <br />C. All exterior mechanical equipment such as air conditioning/heating units and <br />radio/television antennas shall be screened from view so as not to be visible from <br />adjacent properties or streets to the satisfaction of the Community Development <br />Director. This condition shall not apply to wireless cable receivers that do not exceed <br />three feet in diameter. <br /> <br />IX. CONSTRUCTION PROVISIONS <br /> <br />A. Construction activity shall not commence prior to 8:00 a.m. and shall cease by 7:00 p.m. <br />Monday through Friday, and construction activity shall not commence prior to 8:00 a.m. <br />and shall cease by 5:00 p.m. on Sunday and Saturday. No such construction is permitted <br />on Federal holidays. As provided in this City of San Leandro's Noise Ordinance <br />(ORDINANCE NO. 2003 - 005), "construction" shall mean any site preparation, <br />assembly, erection, substantial repair, alteration, demolition or similar action, for or on <br />any private property, public or private right-of-way, streets, structures, utilities, <br />facilities, or other similar property. Construction activities carried on in violation of this <br />Article may be enforced as provided in Section 4-11-1130, and may also be enforced by <br />issuance of a stop work order and/or revocation of any or all permits issued for such <br />construction activity. <br /> <br />B. Construction activity shall not create dust or safety hazards for adjacent properties. Dirt <br />and mud shall not be tracked onto Pacific Avenue, Davis Street, Williams Street or any <br />nearby streets from the project site. <br /> <br />C. Construction debris, and construction materials and equipment shall not be left in the <br />front yard setback of the existing homes <br /> <br />X. INCLUSIONARY HOUSING REQUIREMENTS <br /> <br />A. Prior to issuance of a final map for the condominium conversion, the applicant shall <br />provide the City of San Leandro with an in-lieu payment of approximately $16,082 in <br />due in two equal installments: half upon submittal of the parcel map application to the <br />City of San Leandro and half upon issuance of the final subdivision map by the County <br />of Alameda Recorder. <br /> <br />Agreement to Conditions <br />PLN2007 -00001 <br /> <br />March 15,2007 <br />Page 8 of9 <br />
