WHEREAS, a legal ad was placed in the Daily Review and notices were sent to 983 property owners and to another 394 interested parties to inform them of the proposed Zoning Code and Zoning Map changes; and WHEREAS, a Response to Comments document, which together with the DEIR constitutes the Final Environmental Impact Report ("Final EIR"), has been prepared and circulated; and WHEREAS, no new information was produced by City staff, the Final EIR authors or public comment during the preparation of the Final EIR on the Downtown TOD Strategy which would require recirculation pursuant to the California Environmental Quality Act ("CEQA"); and WHEREAS, the responses to comments contained in the Final EIR on the Downtown TOD Strategy result from a process of multidisciplinary and agency discussions and represent a responsive, good faith evaluation of each comment; and WHEREAS, in August 2007, the Final EIR on the Downtown TaD Strategy was released and was made available for public review; and WHEREAS, on August 23, 2007, the City of San Leandro Planning Commission considered the Final EIR on the Downtown aD Strategy and received public comments thereon, and recommended that this Council certify the Final EIR as complete. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Leandro as follows: 1. The foregoing recitals are true and correct and incorporated herein as findings. 2. Compliance with CEQA. The City Council certifies that: the Final EIR for the Downtown TaD Strategy attached hereto as Exhibit A (On file: Office of the City Clerk), dated August 17, 2007, has been prepared in compliance with the requirements of CEQA; it has been presented to the City Council; the City Council has reviewed and considered the information contained in the Final EIR for the Downtown TaD Strategy, including the record of oral and written comments received during the comment period for the Draft EIR; that public participation in the preparation and review of the Final EIR for the Downtown TaD Strategy has been adequate and in accordance with CEQA; that the Final EIR reflects the independent judgment of the City Council; and all of the information contained therein has substantially influenced all aspects of the decision by the City Council. 3. CEQA FindiDl?:s of Fact Ref!ardin2. Si2.nificant Effects. Section 21081 (a) of the Public Resources Code requires the City Council to make certain findings regarding the significant effects of the proposed Downtown TaD Strategy (the "Findings"). These findings are made for each significant impact identified in the Final EIR, including effects that would be significant, but that will be mitigated by mitigation measures identified in the Final EIR.
